RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2007-02643 INDEX CODE: 107.00 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: He be awarded the Air Force Achievement Medal with 1 Bronze Oak Leaf Cluster (AFAM w/1BOLC) and the Small Arms Expert Marksmanship Ribbon (SAEMR). ________________________________________________________________ _ APPLICANT CONTENDS THAT: He was awarded the AFAMs and the SAEMR and would like these awards added to his DD Form 214, Certificate of Release or Discharge from Active Duty. He was awarded the SAEMR after qualifying in Basic Training from May to Jun 95, (scored 35 out of 40). He is applying for a job in the criminal justice field and these types of awards are noteworthy on his resume. In support of his request, applicant provided a copy of his DD Form 214, certificates and special orders awarding the AFAM. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: Applicant served on active duty in the Air Force from 3 May 95 to 2 Feb 00. He served as an Aircraft Communication/Navigation Systems Journeyman. He was honorably released from active duty for completion of required active service and transferred to the USAFR. ________________________________________________________________ _ AIR FORCE EVALUATION: HQ AFPC/DPSIDR recommends denial of the SAEMR. DPSIDR states the applicant’s military record does not contain documentation to verify award of the SAEMR. Also, he did not provide documentation to support his claim. The SAEMR is awarded to all Air Force service members who, after 1 Jan 63, qualify as “expert” in small-arms marksmanship with either the M-16 rifle or issue handgun. The complete DPSIDR evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 1 Feb 08, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. To date, a response has not been received. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. We note that AFPC/DPSIDR has verified the applicant’s entitlement to the AFAM w/1BOLC and will update his DD Form 214 to reflect this change. However, other than his own assertions, the applicant has not provided any evidence substantiating that he met the required qualifications for award of the SAEMR. Based on the evidence presented we are unable to verify his entitlement to the SAEMR.
