RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2007-03685 INDEX CODE: 107.00 XXXXXXXXXXXXXXXXXXX COUNSEL: NO HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to reflect all of his ribbons and medals, including those for his Vietnam service. ________________________________________________________________ _ APPLICANT CONTENDS THAT: He has no awards or medals listed on his DD Form 214 for his Vietnam service. In support of his appeal, the applicant has provided a copy of an Air Force Manpower and Personnel Center (AFMPC) letter, dated 8 May 1985, notifying him of a correction to item 22C of his DD Form 214 to reflect 2 years, 11 months, and 26 days of foreign service for the period 11 November 1968 to 6 November 1971. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The applicant served on active duty in the Regular Air Force from 7 February 1968 to 7 November 1971. He was honorably released from active duty in the grade of sergeant (E-4) with a total of 3 years, 9 Months, and 1 day of active military service of which 1 year, 9 months, and 18 days was reflected as foreign service. His DD Form 214 indicates he was awarded the National Defense Service Medal and Air Force Good Conduct Medal. On 7 May 1985, AFMPC administratively corrected the applicant’s DD Form 214 to reflect he served 2 years, 11 months, and 26 days of foreign service. The AFMPC letter, dated 8 May 1985, indicates the applicant’s temporary duty to Thailand and Vietnam could not be verified. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPAPP recommends disapproval of the applicant’s request, as there are no documents in his military records that substantiates he performed any service in Vietnam. On 9 January 2008, their office wrote the applicant asking for copies of any documents that he may have to verify his Vietnam/Thailand service; however, he did not reply. The DPAPP evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 14 March 2008 for review and response within 30 days (Exhibit D). As of this date, this office has received no response. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After a thorough review of the available records, we found no evidence to support the applicant performed any service in Vietnam. We took notice of the applicant's complete submission in judging the merits of this case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
