RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2008-00677 INDEX CODE: 131.00 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: The Officer Performance Report (OPR) rendered on him for the period 20 Jul 06 through 19 Jul 07 be included in his Officer Selection Record (OSR) that was considered by the Calendar Year 2007A (CY07A) Major Central Selection Board (CSB). He be considered for promotion to the grade of Major by special selection board (SSB) for the CY07A Major CSB with the corrected record. ________________________________________________________________ _ APPLICANT CONTENDS THAT: Due to an administrative oversight his 19 Jul 07 OPR was not signed and made a matter of record until 7 Jan 08. It was the intent of his commander that his OPR be in his record for consideration by the CY07A Major board. Due to deployments and the squadron being spread out in different locations, his report was not processed in a timely fashion. In support of his request, the applicant provided letters of support from his chain of command, a copy of his OPR, and an excerpt from AFI 36-2501, Officer Promotions and Selective Continuation. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The applicant is currently serving on active duty in the grade of captain. His Total Active Federal Military Service Date (TAFMSD) is 1 Mar 99. A review of the OPRs included in his record for the CY07A Board reflects overall ratings of “meets standards.” He was considered and not selected for promotion to the grade of major by the CY07A Major Central Selection Board (10 Sep 07). ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSOO recommends denial. They note that although it was the evaluators’ intention to have the report filed in the applicant’s OSR, the absence of this report was not an error because it was not required to be filed until 19 Sep 07— after the 10 Sep 07 convening board date. DPSOO further notes that officers being considered by central promotion boards have OPRs with different closeout dates and that it is not realistic to hold the Air Force accountable for the expedition of reports that close out in close proximity to those boards. AFI 36-2406, paragraph 6.5.1.3., Officer and Enlisted Evaluation Systems, states that OPRs on EAD officers are due at HQ AFPC no later than 60 days following closeout of the report. Furthermore, the report was signed by the rater and additional rater on 2 Jan 08, and the reviewer on 7 Jan 08; therefore, it could not have been a matter of record by the board convening date of 10 Sep 07. To allow promotion consideration by SSB based on the inclusion of reports not required to be in the OSR would be unfair to other officers similarly situated. Finally, AFPC/DPSOO states officers meeting a board have the option to submit a letter to the board president addressing any matter of record concerning themselves that they believe is important to their consideration for promotion. As such, the applicant could have written a letter to the board members informing them of the accomplishments mentioned in his report. The complete DPSOO evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 11 Apr 07, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. To date, a response has not been received. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We noted the letters of support the applicant had from his rating chain stating it was their intent to have the OPR made a matter of record for the promotion board. While we cannot state with certainty whether the missing OPR would have made a difference in his promotion results, we do believe it may have prevented him from receiving full and fair consideration for promotion. Therefore, we recommend the records be corrected as indicated below. _______________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that the, Company Grade Officer Performance Report, AF IMT 707B, rendered for the period 20 July 2006 through 19 July 2007, was signed by the rater, additional rater and reviewer on 3 September 2007; and was accepted for file in his Officer Selection Record on 4 September 2007.
