RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2008-03303 INDEX CODE: 100.03 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His two-year Active Duty Service Commitment (ADSC) incurred for promotion to master sergeant (E-7) be removed from his records. _________________________________________________________________ APPLICANT CONTENDS THAT: He was never briefed, nor signed a statement acknowledging an ADSC. He was totally unaware that he had an ADSC or that he had to sign for one. The applicant does not provide any supporting documentation with his appeal. The applicant’s complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: According to the Military Personnel Database, the applicant is currently serving on active duty in the Regular Air Force in the grade of master sergeant with a date of rank of 1 January 2007. He has a Total Active Federal Military Service Date of 4 June 1987 and a projected date of separation of 7 August 2010. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPS recommends denying the applicant’s request. DPS states the applicant was promoted to the rank of master sergeant on 1 January 2007. The ADSC for senior noncommissioned officer promotions is an automatic update within a member’s personnel records. The applicant’s ADSC date was updated to 31 December 2008. Air Force Instruction (AFI) 36-2107, Table 1.1, rule 9, lists the ADSC for promotion to master sergeant as a two-year commitment. AFI 36-2107, paragraph 1.3.1, indicates “Failure to complete an Air Force Form 63 (or other prescribed documentation) does not relieve the member of the ADSC.” It is the ADSC- incurring event and not the signed statement of acknowledgement that consummates the ADSC. DPS indicates the applicant may request a waiver of his ADSC in conjunction with retirement in accordance with AFI 36-3203, or as an exception to policy if he wishes to retire from the Air Force prior to completing his ADSC. The AFPC/DPS evaluation, with attachment, is at Exhibit B. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 26 September 2008, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days (Exhibit C). As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
