He needs his DD Form 214 corrected so he may receive compensation for his diabetes due to Agent Orange exposure. The applicant provides no supporting documentation. The applicant's complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 26 Aug 69, the applicant enlisted in the Regular Air Force. He was progressively promoted to the grade of sergeant having assumed the grade effective and with a date of rank of 1 Jul 71. He was honorably released from active duty on 24 Aug 73. He served 3 years, 11 months and 29 days on active duty of which 1 year and 9 months was foreign service. His DD Form 214 reflects he was awarded the National Defense Service Medal, Air Force Commendation Medal, Air Force Good Conduct Medal, Vietnam Service Medal, and the Republic of Vietnam Campaign Medal. _________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPAPP recommends denial. DPAPP states that a review of the applicant's master personnel records failed to provide any document that substantiated any time in Vietnam. The AFPC/DPAPP complete evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Applicant provides a copy of the letter he submitted to the National Archives requesting assistance in obtaining documents reflecting his temporary duty in Vietnam. The applicant's complete letter is at Exhibit E. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. The applicant’s contentions are duly noted; however, we do not find these uncorroborated assertions, in and by themselves, sufficiently persuasive to override the rationale provided by the Air Force office of primary responsibility (OPR). While the possibility exists that the applicant may have been in Vietnam at some time, he has provided no evidence substantiating he was TDY to Vietnam for any specific dates or length of time. Absent such evidence, we agree with the recommendation of the Air Force OPR and adopt the rationale expressed as the basis for our decision that the applicant has failed to sustain his burden of proof that he has suffered either an error or an injustice. However, should the applicant provide more expansive evidence such as flight records or travel vouchers that can verify he was in Vietnam, we would reconsider his request.
