RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-01107 COUNSEL: NONE HEARING DESIRED: NO ___________________________________________________________________ APPLICANT REQUESTS THAT: 1. He be awarded the Presidential Unit Citation (PUC) – administratively corrected. 2. He be awarded the Air Force Outstanding Unit Award with Valor (AFOUA w/V). 3. He be awarded the Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P) – administratively corrected. 4. He be awarded any unit awards while assigned to the 308th Strategic Missile Wing (308th SMW), Little Rock AFB, AR from Oct 69 to Jun 75. ___________________________________________________________________ APPLICANT CONTENDS THAT: The Air Force Personnel Center (AFPC) did not update his records with the appropriate awards and citations. He was assigned to the 90th Tactical Fighter Squadron in Bien Hoa, Vietnam, from 28 Oct 68 to 7 Sep 69. In support of his request, applicant provides a copy of his DD Form 214, Report of Separation from Active Duty, and a printout from the 3rd Wing History Office. His complete submission, with attachments, is at Exhibit A. ___________________________________________________________________ STATEMENT OF FACTS: The applicant served in the Regular Air Force and was progressively promoted to the grade of captain (0-3), having assumed that grade effective and with a date of rank of 20 Jun 67. He was honorably discharged on 30 Jun 75 after serving 11 years, 9 months, and 6 days on active duty. The applicant’s AF Form 7, Airman Military Record, reflects he served in Bien Hoa (for the 3rd FMS and the 90th TFS) from 5 Sep 68 to 17 Jan 69. The applicant’s officer performance report with a close out date of 9 Jun 69 and his letter of evaluation with a close out date of 18 Aug 69 reflects he was assigned to the 90th TFS, Bien Hoa, Vietnam. AFPC/DPSIDR was able to verify the applicant’s entitlement to the PUC and RVNGC w/P, and Vietnam Service Medal with one silver service star (VSM w/1SSS) and will administratively correct his records. The AFOUA criteria: Units that have distinguished themselves by exceptionally meritorious service or outstanding achievement that clearly sets the unit above and apart from similar units may be awarded the AFOUA by the Secretary of the Air Force. ___________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial of the AFOUA w/V. DPSIDR states that after a thorough review of the applicant’s records, they were able to verify his entitlement to the PUC, VSM w/1SSS, and the RVNGC w/P; however, they were unable to verify his entitlement to the AFOUA w/V. The DPSIDR complete evaluation is at Exhibit C. ___________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant recommends that DPSIDR contact the 90th TFS historian and/or the webmaster in order to confirm the 90th TFS was awarded the AFOUA w/V for the period he was assigned. He wants to know if he qualifies for the PUC with one oak leaf cluster (PUC w/1OLC). He also requests to be awarded any unit awards while assigned to the 308th SMW. The applicant’s complete submission is at Exhibit E. ___________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice with regard to the applicant’s request for the AFOUA w/V and any unit awards while assigned to the 308th SMW. In this respect, the applicant has not provided any documentary evidence to substantiate his claim that he meets the criteria for these awards; therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted.
