RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-01896 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to reflect: a. The Bronze Star Medal with Valor (BSM w/V). b. All other awards he might be entitled. _________________________________________________________________ APPLICANT CONTENDS THAT: His BSM w/V and other awards were not added to his DD Form 214 upon his separation from the Air Force. In support of his application, the applicant provides copies of his DD Form 214 and his BSM citation. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force on 4 March 1966. He was progressively promoted to the grade of sergeant with a date of rank of 1 December 1968. On 16 December 1969, he was honorably discharged after serving 3 years, 9 months and 13 days of active service. The applicant’s Enlisted Performance Report (EPR) covering the period 15 September 1967 to 14 September 1968 indicates he was awarded the BSM w/V for his action during a base attack on Tan Son Nhut Air Base, Vietnam. The applicant’s DD Form 214 was corrected to reflect he was entitled to the Presidential Unit Citation (PUC), the Vietnam Service Medal with four Bronze Service Stars (VSM w/4 BSS), and the Republic of Vietnam Gallantry Cross with Palm (RVGC w/P). _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDRA recommends denial. DPSIDRA states they were unable to produce a copy of the special order authorizing him the BSM. A letter was sent to the applicant requesting he provide a copy of the special order, however, he did not respond. The complete DPSIDRA evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 April 2010 for review and response within 30 days (Exhibit D). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. While the applicant could not provide a copy of the order awarding him the BSM w/V, we are persuaded by the evidence provided by the applicant that he received the award for his heroic actions in Vietnam.
