RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-02667 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect his three active duty tours of more than 90 days each in order for him to be eligible for Post 9/11 GI Bill benefits. _________________________________________________________________ APPLICANT CONTENDS THAT: He has three tours of over 90 consecutive days of active duty which are not showing in his military records. He served from January 1999 to May 1999 at Shaw Air Force Base (AFB), South Carolina; from September 1999 to December 1999 at Ali Al Salem Air Base, Kuwait; and he was activated and served from February 2002 to July 2002 at Rhein Main Air Base, Germany. In support of his appeal, the applicant provides copies of an award nomination, Supplemental Evaluation Sheet, and an award citation. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: According to the applicant’s NGB Form 22, National Guard Bureau Report of Separation and Record of Service, he served from 25 January 1996 to 14 June 2003 (7 years, 4 months, and 20 days) in the Illinois Air National Guard. He was progressively promoted to the grade of staff sergeant (E-5) with a date of rank of 21 September 2000. According to a DD Form 214, Certificate of Release or Discharge from Active Duty, provided by the applicant, he served from 23 February 2002 to 4 July 2002 on active duty in support of OPERATION JOINT FORGE, for a total of 4 months and 12 days. ARPC/DPSVT contacted the applicant twice by email and once by letter requesting copies of orders or travel vouchers to support his request. In response, the applicant provided a DD Form 214 for the period 23 February 2002 to 4 July 2002. _________________________________________________________________ AIR FORCE EVALUATION: ARPC/DPSVT recommends denial. DPSVT states that based on the information provided by the applicant in his initial request, they were unable to verify evidence to support his request. The DPSVT complete evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: In response to the Air Force evaluation, the applicant provided a copy of his DD Form 214 for the period 23 February 2002 to 4 July 2002. A copy of the applicant’s complete response, with attachment, is at Exhibit E. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice to provide partial relief. We note the applicant asserts he completed three tours of active duty over 90 days each to qualify for Post 9/11 GI Bill benefits; however, based on the evidence of record and the submitted documentation, he served only one tour of active duty over 90 days (23 February 2002 to 4 July 2002) subsequent to 11 September 2001. ARPC/DPSVN was able to confirm the applicant had a total of 145 days of active duty service since 11 September 2001. This qualifies the applicant to apply to the Department of Veteran Affairs for Chapter 33, Post 9/11 GI Bill benefits.
