RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-02694 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: Her narrative reason for separation “Entry-Level Performance and Conduct” be changed to “Academic Failure.” _________________________________________________________________ APPLICANT CONTENDS THAT: She was not separated for misconduct or bad performance. She was separated for twice failing an Aerospace Medical Service Apprentice course. In support of her request, the applicant provides a personal statement and documents extracted from her military personnel records. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force on 8 December 2009. The applicant was notified by her commander on 24 May 2010, of his intent to recommend her discharge from the Air Force under the provisions of AFPD 36-32 and AFI 36-3208, paragraph 5.22. The specific reason was the applicant’s failure to perform her assigned duties by not making satisfactory progress in the Aerospace Medical Service Apprentice (Phase I) course. She was advised of her rights in this matter and elected not to submit statements in her own behalf. The discharge authority concurred with the recommendation and directed an entry-level separation. The applicant was discharged on 7 June 2010. She served 6 months on active duty. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSOS recommends denial. DPSOS states the applicant’s characterization is correct as reflected on her DD Form 214. Airmen are given entry-level separation/uncharacterized service when separation is initiated in the first 180 days of continuous active service. The Department of Defense (DoD) determined if a member served less than 180 days continuous active service, it would be unfair to the member and the service to characterize their limited service. Therefore, the uncharacterized service which resulted in the reentry code of 2C is correct and in accordance with DoD and Air Force instructions. Based on the documentation on file in the master personnel records, the discharge to include the narrative reason for separation was appropriately administered and within the discretion of the discharge authority. The applicant did not provide any evidence of an error or injustice in the processing of her discharge warranting a change to her narrative reason for separation. The DPSOS complete evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 17 December 2010, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days (Exhibit D). As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. After reviewing the complete evidence of record we believe the term “performance and conduct,” which currently accompanies her Narrative Reason for Discharge, does not accurately identify the circumstances surrounding her separation. It appears to us that the word “conduct” could be misconstrued to infer that her separation for failure to make satisfactory progress was also due to misconduct. While the applicant may have had problems progressing in the required training program, her discharge was not due to misconduct. Therefore, in view of a possible injustice to the applicant, we recommend her records be corrected to the extent indicated below. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected by deleting the words “and conduct” from Block 28 (Narrative Reason for Separation) on her DD Form 214, Certificate of Release or Discharge from Active Duty. _________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2010-02694 in Executive Session on 1 February 2011, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
