RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-03053 COUNSEL: NONE HEARING DESIRED: YES _________________________________________________________________ APPLICANT REQUESTS THAT: Her reentry (RE) code of “2C” (Involuntarily separated with an honorable discharge; or entry level separation without characterization of service), her narrative reason for separation of “Personality Disorder,” and her separation code of “JFX.”, be changed to allow her to reenter the military. _________________________________________________________________ APPLICANT CONTENDS THAT: She does not have a personality disorder. She was told that Block 28 of her DD Form 214, Certificate of Release or Discharge from Active Duty, would indicate “Failure to cope with military life.” She was facing being apart from her husband for over three years; therefore, she was given the option to separate. She would love to serve again. The applicant does not provide any evidence in support of her appeal. The applicant’s complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant was a former member of the Regular Air Force who served in the Tactical Aircraft Maintenance career field and was promoted to the grade of airman (E-2) effective 13 March 2006. On 1 June 2006, the applicant was evaluated for depression secondary to being separated from her husband who was stationed at another location. She was diagnosed as having a mental disorder of Adjustment Disorder with Mixed Anxiety and Depressed Mood. On 11 October 2006, the applicant received notification that her commander was recommending her for an honorable discharge for Conditions that Interfere with Military Service: Mental Disorder – Adjustment Disorder, in accordance with Air Force Program Directive 36-32 and Air Force Instruction 36-3208. The applicant acknowledged receipt of the notification, consulted counsel, and waived her right to submit a statement in her own behalf. Subsequent to the Staff Judge Advocate finding the case to be legally sufficient, the discharge authority approved the separation and directed the applicant be discharged with an honorable discharge. The applicant was honorably discharged effective 14 November 2006 with an RE code “2C,” a narrative reason for separation of “Personality Disorder,” and a separation code of “JFX.” She served 1 year, 2 months, and 2 days on active duty. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSOS recommends the applicant’s separation code be corrected to reflect “JFY” and her narrative reason for separation be changed to “Adjustment Disorder.” DPSOS states the applicant’s separation code and narrative reason for separation, as indicated on her DD Form 214, are incorrect. Since she was diagnosed with an adjustment disorder and anxiety and depressed mood, the DD Form 214 should have reflected the separation code and narrative reason for separation as recommended. Although they recommend these items be corrected, the corrective action will not result in a more favorable reenlistment condition than what currently appears on her DD Form 214. The complete DPSOS evaluation is at Exhibits C. AFPC/DPSOA recommends denying the applicant’s request to change her RE code. DPSOS states the RE code “2C” is required based on her involuntary separation with an honorable characterization of service in accordance with Air Force Instruction 36-2606. The applicant does not provide any proof of an error or injustice in reference to her RE code. The DPSOS recommendation to change the applicant’s separation code and narrative reason for separation does not affect her RE code. The complete DPSOA evaluation is at Exhibit D. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 11 February 2011, for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting partial approval of the applicant’s requests. In that regard, we note that AFPC/DPSOS has verified that the separation code and narrative reason reflected on the applicant’s DD Form 214 are incorrect since the applicant was diagnosed with an “Adjustment Disorder” rather than the “Personality Disorder” reflected on her DD Form 214. As such, we agree with the recommendation of DPSOS and adopt the rationale expressed as the basis for changing the narrative reason for the applicant’s separation to “Adjustment Disorder” with the corresponding separation code “JFY.” However, we note that DPSOS states that these changes have no bearing on the applicant’s reentry code and that the Air Force office of responsibility, AFPC/DPSOA, recommends this part of the applicant’s request be denied. After reviewing the complete evidence of record, we agree with DPSOA’s recommendation and adopt the rationale expressed as the basis for our determination the applicant has not been the victim of error or injustice regarding the part of her appeal. Therefore, we recommend the applicant’s records be corrected only to the extent indicated below. 4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that the narrative reason for separation, issued in conjunction with her honorable discharge on 14 November 2006, was “Adjustment Disorder” and the separation program designator (SPD) code was “JFY.” _________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2010-03053 in Executive Session on 26 May 2011, under the provisions of AFI 36-2603: All members voted to correct the records, as recommended.
