RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-03205 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: He be awarded the Republic of Vietnam Gallantry Cross with Palm (RVGC w/P) and any other omitted unit awards. _________________________________________________________________ APPLICANT CONTENDS THAT: The RVGC w/P was omitted from his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge. In support of his request, the applicant provides a copy of his DD Form 214. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force on 20 March 1962. On 19 March 1970, the applicant was honorably discharged in the grade of staff sergeant. He served 8 years on active duty with 1 year and 1 day of foreign and/or sea service. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDRA recommends denial. DPSIDRA states they were able to verify the applicant’s entitlement to the Presidential Unit Citation (PUC), the Air Force Outstanding Unit Award with one Oak Leaf Cluster (AFOUA w/1 OLC), the National Defense Service Medal (NDSM), two Bronze Service Stars to his previously awarded Vietnam Service Medal (VSM w/2 BSS) and one Oak Leaf Cluster to his previously awarded Air Force Longevity Service Award (AFLSA w/1 OLC). The applicant’s record will be updated by the appropriate office. In accordance with the DoD 1348.33M, the RVGC w/P is awarded to certain units of the United States Armed Forces for valorous combat achievement during the Vietnam War. After a thorough review of the Air Force Pamphlet 900-2, Volumes I-IV, DPSIDRA was unable to verify the 314th Troop Carrier Wing, Detachment 1 receiving award of the RVGC w/P. The DPSIDRA complete evaluation, with attachments, is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 19 November 2010, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days (Exhibit D). As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. The applicant’s contentions are duly noted; however, after reviewing the evidence of record we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not provided evidence showing his entitlement to the RVGC w/P.
