RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-03980 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to reflect the following: 1. Foreign Service in Guam from Jun 65 to Jan 66. 2. All ribbons, awards, and decorations due him for four years of service. (Will be administratively corrected to add the National Defense Service Medal (NDSM), and the Air Force Longevity Service Award (AFLSA)). 3. His service during the Cuban Missile Crisis be added to his DD Form 214. (Specific periods/locations of service are not annotated on the DD Form 214; a letter explaining this was sent to the applicant.) _________________________________________________________________ APPLICANT CONTENDS THAT: His DD Form 214 does not show his service in Guam, service during the Cuban Missile Crisis, or any overseas ribbons or awards. In support of his request, the applicant provides a copy of his DD Form 214. The applicant's complete submission, with attachment, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant served on active duty from 15 Jan 62 to 14 Jan 66. He was honorably released from active for completion of term of service. He served a total of four years on active duty, with four months and eight days being Foreign Service. AFPC/DPSIDR verified the applicant’s entitlement to the NDSM for his service during the Vietnam Conflict, and the AFLSA for his four years of continuous honorable service, and his DD Form 214 will be corrected to reflect these medals. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. DPAPP states they were unable to locate documentation that confirms the applicant served in Guam and inclusive periods. The applicant was asked to provide documentation to support his claim, i.e., travel vouchers, evaluation reports, letters of evaluation, decorations, or some other official military document that reflects service in Guam; however, the applicant did not respond to this request. The complete DPAPP evaluation is at Exhibit B. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 25 Mar 11, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. To date, a response has not been received (Exhibit C). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice with regards to the applicant’s request to add Foreign Service in Guam and service during the Cuban Missile Crisis to his DD Form 214. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. Therefore, with the exception of the awards that will be administratively added to his records, we find no basis to recommend further relief in this case. _________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. _________________________________________________________________ The following members of the Board considered Docket Number BC-2010-03980 in Executive Session on 24 May 11, under the provisions of AFI 36-2603: The following documentary evidence was considered: Exhibit A.
