RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-01057 COUNSEL: NONE HEARING DESIRED: YES _________________________________________________________________ APPLICANT REQUESTS THAT: He be allowed to transfer his Post 9/11 GI Bill benefits to his dependents. _________________________________________________________________ APPLICANT CONTENDS THAT: He applied to transfer benefits from the Montgomery GI Bill to the Post 9/11 GI Bill before he deployed to Iraq. He left immediately upon completing the request for training and deployment. As a result, he did not receive the email notification from AFPC advising that he needed to accomplish the Statement of Understanding (SOU) before his departure. He completed the entire transfer process and had a problem with the AFPC website and subsequent communication problem due to a deployment which kept the transfer from being completed in 2009. In support of his request, the applicant submits a copy of his Post 9/11 GI Bill Transfer of Educational Benefits Statement of Understanding and a transfer request form. The applicant's complete submission, with attachments, at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving on extended active duty in the grade of lieutenant colonel. The remaining relevant facts pertaining to this application, extracted from the applicant’s military records, are contained in the letter prepared by the appropriate office of the Air Force at Exhibit B. _________________________________________________________________ AIR FORCE EVALUATION: USAF/A1PA recommends denial. A1PA states based on the applicant’s pre-deployment training and deployment timeline, the potential does exist that he was unable to retrieve the emails notifying him he needed to take additional action to finalize his transfer. However, the applicant did not follow-up on his transfer until 10 March 2011. The A1PA complete evaluation is at Exhibit B. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 20 May 2011, a copy of the Air Force evaluation was forwarded to the applicant for review and response within 30 days. As of this date, no response has been received by this office (Exhibit C.) _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting corrective action. In this regard, after our review of the evidence before us and noting, in particular, that based on the applicant’s pre-deployment training and deployment timeline, we believe he was unable to timely take the additional actions necessary to finalize his transfer of benefits. Therefore, the Board elects to resolve any doubt in this matter in behalf of the applicant and recommends the records be corrected as indicated below. 4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT, be corrected to show that on 24 September 2009, he elected to transfer his Post 9/11 GI Bill Educational Benefits. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2011-01057 in Executive Session on 30 April 2012, under the provisions of AFI 36-2603: All members voted to correct the record and requested.
