RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-01735 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge be corrected to reflect entitlement to the Meritorious Service Medal (MSM). _________________________________________________________________ APPLICANT CONTENDS THAT: On 3 Oct 74, he was issued a MSM and someone forgot to add it to his DD Form 214. The applicant did not provide any documentation in support of his request. The applicant's complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: On 31 Oct 74, the applicant was retired in the grade of technical sergeant. He is credited with 20 years, zero (0) months and 19 days of active service. By letter dated 18 Jul 11, HQ AFPC/DPSIDR was able to verify the applicant’s entitlement to the Air Force Outstanding Unit Award with Valor and one oak leaf cluster (AFOUA w/V and 1 OLC), Noncommissioned Officer Professional Military Education Graduate Ribbon (NCOPMEGR), the Republic of Vietnam Campaign Medal (RVCM), and three Bronze Service Stars (BSS) to be worn with the Vietnam Service Medal. The records will be administratively corrected by AFPC to reflect these entitlements. _________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPSIDR recommends denial. DPSIDR states “the MSM may be awarded to any member of the Armed Forces of the United States who distinguishes themselves by either outstanding achievement or meritorious service to the United States.” The applicant’s official military record does not contain any documentation which would indicate he was awarded the MSM during his service career. There is no MSM special order, citation or certificate available. The complete DPSIDR evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 29 Jul 11 for review and comment within 30 days (Exhibit D). As of this date, this office has not received a response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. The applicant’s contentions are duly noted; however, after reviewing the evidence of record we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not provided evidence showing his entitlement to the Meritorious Service Medal. Therefore, other than the administrative corrections noted by the Air Force OPR, we do not find a basis to recommend granting the relief sought in the application.
