Vietnam Service Medal (VSM). 2. Republic of Vietnam Campaign Medal (RVCM). 3. Air Force Outstanding Unit Award (AFOUA) (administratively resolved). ________________________________________________________________ APPLICANT CONTENDS THAT: He went on temporary duty (TDY) from the Philippines to Vietnam. in 1966, qualifying him for the AFOUA, VSM and VCM. The applicant’s complete submission, with attachments, is at Exhibit A. _________________ ______________________________________________ STATEMENT OF FACTS: According to the applicant’s military personnel records, he enlisted in the Regular Air Force on 30 Apr 1963 and served on active duty until his Honorable discharge on 7 Nov 1966. On 14 Nov 11, AFPC/DPSOY notified the applicant of his entitlement to the AFOUA and indicated that his records would be updated administratively. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is attached at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial of the applicant’s requests for the VSM and the RVCM, indicating there is no evidence of an error or injustice. To be awarded the VSM based upon a TDY a member must have served (in Vietnam) on temporary duty for at least 30 consecutive days or 60 non-consecutive days. Those time limitations may be waived for personnel participating in actual combat operations. To be awarded the RVCM based on a TDY a member must have served in South Vietnam for six months during the period 1 Mar 1961 and 28 Mar 1973, or been assigned in Vietnam on 28 Jan 1973, and who served a minimum of 60 calendar days in Vietnam during the period 29 Jan 1973 to 28 March 1973. While his records show he was TDY to An Khe Airfield, Vietnam for two weeks from 26 Jan 1966 to 6 Feb 1966, two weeks are insufficient to meet the minimum award requirements for either the VSM or the RVCM. A complete copy of the AFPC/DPAPP evaluation is at Exhibit D. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 2 Dec 2011 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit E). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. We note the Air Force OPR has determined the applicant is entitled to the AFOUA and that his records have been administratively corrected.
