RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-01994 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: The Foreign and/or Sea Service Dates on his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be changed from 2 months and 4 days to 4 months and 2 days. ________________________________________________________________ APPLICANT CONTENDS THAT: He was overseas longer than 2 months. He only noticed the error as he worked on a claim for benefits with the Department of Veteran’s Affairs. In support of his appeal, the applicant provides his DD Form 214, medical records and documentation from his master personnel file. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Air Force who was honorably discharged on 20 April 1970. His DD Form 214 reflects he served 2 months and 4 days of Foreign Service. On 25 May 2011, the applicant submitted a request to correct his Foreign Service to reflect he served overseas for 4 months and 2 days. AFPC/DPAPP responded to that request and confirmed he had boots on the ground in Guam from 1 October 1968 to 4 December 1968. Therefore, his case was administratively closed on 14 October 2011. The applicant submitted another request dated 27 September 2012 requesting his DD Form 214 be corrected to show he served overseas for 4 months and 2 days. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. The applicant’s master personnel record does not contain information that reflects he served more than 2 months and 4 days in Guam. The complete DPAPP evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 December 2012 for review and comment within 30 days. As of this date, this office has received no response (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After a thorough review of the applicant’s submission in judging the merits of the case, we are not persuaded that a change in the record is warranted. The applicant’s contentions are duly noted; however, he has not provided substantial evidence to override the rationale provided by AFPC/DPAPP. Therefore, we agree with their recommendation and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
