RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-02063 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect award of the following: 1. The Global War on Terrorism Expeditionary Medal (GWOT-E). 2. The Global War on Terrorism Service Medal (GWOT-S) (administratively corrected). _________________________________________________________________ APPLICANT CONTENDS THAT: These awards were authorized after his release from active duty. He further believes he is eligible for these medals based on the criteria which includes the timeframe of his active service. The applicant's complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant’s records reflect he served on active duty from 10 Sep 82 to 31 Dec 02. He is credited with two years, one month and five days of foreign service. The Defense Finance and Accounting Service (DFAS) verified the applicant served in Bosnia Herzegovina from 17 Nov 99 through 5 Mar 00 and in Croatia from 13 Jun 01 through 14 Sep 01. On 29 Jun 11, AFPC/DPSIDRA informed the applicant his entitlement to the GWOT-S had been verified and that it was also determined he was eligible for the Korean Defense Service Medal (KDSM); his records will be administratively corrected to reflect these awards. DPSIDRA further informed the applicant that they were unable to verify his entitlement to the GWOT-E. The GWOT-E is awarded to Air Force active duty, reserve and air national guard personnel who have deployed abroad to areas of eligibility (AOE) to include Iraq, on or after 11 Sep 01 for service in Operations ENDURING FREEDOM (OEF) or IRAQI FREEDOM (OIF) and meet one of the following criteria: Being assigned, attached or mobilized to a unit participating in OEF/OIF and serving for 30 consecutive or 60 nonconsecutive days; be engaged in actual combat against the enemy and under circumstances involving grave danger or death or serious bodily injury from enemy action, regardless of time served in OEF/OIF; killed, wounded or injured requiring medical evacuation from OEF/OIF; service members who, as a regularly assigned crew member flying sorties into, out of, within or over the AOE in direct support of OEF/OIF, are eligible to qualify for award of the GWOT-E. Each day that one or more sorties are flown shall count as one day toward the 30 or 60 day requirement. _________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPSIDR recommends denial. DPSIDR notes there was no official documentation in the applicant’s military personnel record verifying he was deployed to the AOE in support of OEF or OIF. However, the applicant’s service in Croatia was in support of Operation JOINT FORGE and he received the Air Force Expeditionary Medal (AFEM) for his participation. The complete AFPC/DPSIDR evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant 15 Jul 11, for review and comment within 30 days. As of this date, no response has been received by this office. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with regard to the applicant’s request for award of the GWOT-E. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our decision the applicant has failed to sustain his burden of establishing that he has suffered either an error or an injustice.
