He be entitled to the Armed Forces Expeditionary Medal (AFEM). 2. He be entitled to the Korean Defense Service Medal (KDSM), and any other medal he may have earned while assigned to the 80th Tactical Fighter Squadron (TFS). ________________________________________________________________ APPLICANT CONTENDS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, does not reflect the KDSM or the AFEM. In support of his request, the applicant provides copies of a Chronological Listing of Service, Standard Form 600, Chronological Record of Medical Care, and extracts from the internet pertaining to the 80 TFS. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant served on active duty in the Regular Air Force from 5 Apr 66 to 29 Mar 70. His DD Form 214 reflects a total of 3 years, 11 months, and 25 days of total active service with 1 year, 11 months and 13 days of Foreign Service. The AFEM is awarded to members of the United States Armed Forces who, after 1 Jul 58, have participated in a United States military operation and encountered foreign armed opposition, or were in danger of hostile action by foreign Armed Forces. Service members must have been directly assigned or detailed to a unit that participated in or engaged in direct support of the specified operation for 30 consecutive or 60 non-consecutive days provided the support entered the designated area of eligibility (AOE). The KDSM is awarded to personnel who have been physically present in the AOE for 30 consecutive or 60 non-consecutive days. Individuals must have been assigned, attached or mobilized to units operating or serving on all the land area of the Republic of Korea, on the contiguous waters out to 12 nautical miles, and all airspace above the stated land and water areas. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial, stating, in part, the documentation in the applicant’s personnel file reflects TDY service in Korea; however, the Directorate of Personnel Assignments (DPA) office verified the applicant’s TDY service was only for 23 consecutive days (1 Feb 69 to 24 Feb 69), rendering him ineligible for award of the AFEM and KDSM. The complete DPSIDR evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant disagrees with the 23 days service time DPAPP verified as proof of “boots on the ground” for the Republic of Korea. He contends he went TDY twice to Korea, but cannot remember the dates of the second TDY. The applicant’s complete response, with attachments, is at Exhibit E. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice regarding the applicant’s request for the AFEM and KDSM. We took notice of the applicant’s complete submission in judging the merits of the case, to include his response to the Air Force’s evaluation; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
