His enlistment dates be changed to reflect correct time and service (Administratively resolved). 2. He receive copies of all his DD Forms 214, Certificate of Release or Discharge from Active Duty (Administratively resolved). 3. His records be corrected to reflect he had “Boots on the ground” in Thailand (Administratively Resolved), Vietnam, and Laos. _________________________________________________________________ APPLICANT CONTENDS THAT: He was in Vietnam, Laos, and Thailand and was TDY to those locations on several occasions from 31 May 68 through 31 Oct 69. Boots on the ground should be verified for all three locations. In support of his appeal, the applicant provides a personal statement, DD Forms 13 and 1613, Statement of Service, an Air Force Form 7, Report on Individual Personnel, several certificates of accomplishment, and notarized photographs. The applicant’s complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant began his military service on 17 May 66 and was progressively promoted to the grade of master sergeant (E-7), effective and with a date of rank (DOR) of 1 Oct 83. He served until 8 Dec 88 when he was placed on the Temporary Disability Retired List (TDRL). He was removed from the TDRL on 14 Feb 91 and reenlisted in the USAF on 15 Feb 91. On 31 Jul 92, he was released from active duty and retired, effective 1 Aug 92. On 6 Dec 11, AFPC/DPAPP notified the applicant that they had verified his foreign service in Thailand from 15 Sep 67 through 15 Apr 69. On 13 Dec 11, AFPC/DPSIPV notified the applicant of their determination that his service dates, as reflected on two of his DD Forms 214 were incorrect and of their action to correct his records administratively. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial with respect to the applicant’s request that his records show boots on the ground in Vietnam and Laos due to a lack of evidence in his Master Personnel Records and the documentation submitted. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant reiterates that he served in Vietnam and Laos. In support of his response, the applicant provides an expanded statement and copies of three notarized affidavits from individuals attesting to his service in Vietnam. The applicant’s complete response, with attachments, is at Exhibit D. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case, to include his response to the advisory opinion rendered in his case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. The additional evidence presented by the applicant in his rebuttal statement is not sufficient enough to cause us to reconsider our decision.
