RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-04711 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His two fitness assessment (FA) failures dated 13 Oct 10 and 14 Jan 11 be removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: His two FA failures were due to a medical reason that was later discovered to be Asthma and he was not receiving treatment for it during the assessments. In support of his request, the applicant provides copies of a doctor’s statement, AF Form 469, Duty Limiting Condition Report and medical records. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of staff sergeant. In a letter dated 17 Nov 11, the Family Practice Physician noted the applicant had been complaining of rib pain and shortness of breath which resulted in one emergency room visit in Jan 11 as well as multiple clinic visits. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is attached at Exhibit B. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial. DPSIM states the applicant’s diagnosis has been confirmed; however, after review of his fitness test history, the applicant has been able to pass the fitness assessments prior to and after the tests in question. On 13 Oct 10, the applicant tested on all four components; he scored 44.90 points for the cardio test; 15.10 points for abdominal circumference; 6.80 points for pushups, and 6.00 points for sit-ups. On 14 Jan 11, he scored 27.10 points for the cardio test; 15.50 points for abdominal circumference; 8.40 points for pushups, and 6.50 points for sit-ups. The complete DPSIM evaluation is at Exhibit B. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states he disagrees with the Air Force advisory opinion because he could have had Asthma well before he had difficulty breathing during his FA. During the period in question, he attended all “Be Well” classes provided at the Health and Wellness Center (HAWC). In addition, he attended the “Great 8” physical improvement course while getting treatment and, as a result, he was able to pass his next two FAs. The applicant’s complete submission is at Exhibit D. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting relief. In this respect, we note the applicant while undergoing doctor’s care was found to have exercise-induced asthma which, according to his doctor, may have contributed to his inability to pass his fitness assessments. As such. we find the evidence submitted in support of his appeal sufficient to conclude that he had a medical condition that should have excluded him from testing. Considering the potentially harmful consequences of the subject actions on the applicant’s career, we believe the interest of justice would best be served by removing the Oct 10 and Jan 11 “unsatisfactory” fitness assessments scores from his records. Accordingly, we recommend his records be corrected to the extent indicated below. _______________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that the Fitness Assessments (FA) dated 13 October 2010 and 14 January 2011, be, declared void and removed from his records. ________________________________________________________________ The following members of the Board considered BC-2011-04711 in Executive Session on 22 May 12 under the provisions of AFI 36- 2603: All members voted to correct the records, as recommended.
