RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2011-04966 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His official military records be corrected by having his Fitness Assessment (FA), dated 30 Aug 11, declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: On the day of his FA he was not feeling well, but since it was too late to reschedule he took the FA at 0500. During the run portion of the FA he started vomiting but continued as he was told. He finished his run 14 seconds over his maximum allowable run time, and therefore failed the FA. He sought medical attention that same day, and the Primary Care provider signed a memo stating he had an acute medical condition that should allow him to retest on a future date. In support of his request, the applicant provides copies of the Physician’s Assistant memo and an extract his AFFMS record. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: According to the applicant’s military personnel records, he currently serves in the Regular Air Force in the grade of Airman First Class (E-3). On 30 Aug 11, the applicant failed the contested FA, earning a composite score of 76.80, but failing the run portion of the assessment. On 1 Dec 11, the applicant retook and passed the FA, earning an overall score of 88.20. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial indicating there is no evidence of an error or injustice. On 15 Mar 12, they sent the applicant a memo requesting a copy of AF Form 108, Physical Fitness Education and Intervention Processing, documenting his illness, but he did not provide the requested documentation. Therefore, the applicant’s request should be denied. The complete AFPC/DPSIM evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 May 12 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The member contends that his illness precluded him from attaining a passing score on his 30 Aug 11 FA. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant has raised sufficient doubt as to whether or not he had a reasonable opportunity to attain a passing score on his FA. While we note the recommendation from AFPC/DPSIM that his request be denied, we believe the signed memo from his attending physician is sufficient to convince us the applicant’s acute medical condition precluded him from passing the FA. Therefore, we believe it appropriate to resolve any doubt in the applicant’s favor and recommend the applicant’s records be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his Fitness Assessment (FA), dated 30 August 2011, be declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2011-04966 in Executive Session on 26 Jul 12, under the provisions of AFI 36-2603: All members voted to correct the records as recommended.
