RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-01714 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: Her 24 Mar 11 Fitness Assessment (FA) be declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: She had an undiagnosed medical condition which should have precluded her from participating in the contested FA. Despite her repeated visits to her Primary Care Manager (PCM) her condition was misdiagnosed as low back pain associated with the Jul 10 birth of her child. It was not until after the contested FA that she was finally diagnosed with a herniated disc, pinched sciatic nerve, and coccyx (tailbone) abnormality, all of which precluded her from preparing for the contested FA. In support of her appeal, the applicant provides copies of a memo from her commander requesting the FA be removed, a memo from her PCM, and an AF Form 469, Duty Limiting Condition Report; two AF Forms 422, Notification of Air Force Member’s Qualification Status; and, her Individual FA History. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant served in the Regular Air Force in the grade of Technical Sergeant (E-6) during the matter under review. On 24 Mar 11, the applicant participated in the contested FA and attained an unsatisfactory score. The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility, which is included at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial of the applicant’s request to remove the FA score in question. However, DPSIM recommends the cardio, pushup, and sit-up components of the applicant’s 24 Mar 11 FA be updated to reflect “Exempt,” but the abdominal circumference remains in the AFMMS. The applicant was given an AF Form 469, dated 27 Apr 11, and an AF IMT 422, dated 16 May 11, exempting her from the 1.5 mile run, pushups, and sit-ups; however, all members are required to complete an abdominal circumference. This change will result in an overall composite score of 48.00 (Unsatisfactory.) A complete copy of the AFPC/DPSIM evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 19 Jun 12 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. The applicant contends her medical condition precluded her from passing the contested Fitness Assessment (FA). After a thorough review of the evidence of record and the applicant’s complete submission, we believe a preponderance of the evidence supports corrective action. While we note the comments from AFPC/DPSIM indicating all members are required to complete the abdominal circumference portion of the FA, we believe the documentation submitted by the applicant, specifically, the documentation signed by a Nurse Practitioner indicating she should not have taken the FA during this period, and her commander’s request to remove the FA in question, is sufficient for us to recommend granting the requested relief.
