Air Force Outstanding Unit Award (AFOUA) (administratively resolved). 2. Presidential Unit citation (PUC). _________________________________________________________________ APPLICANT CONTENDS THAT: He is entitled to the AFOUA and PUC for his service with the following units: 11th Air Refueling Squadron, 376th Organizational Maintenance Squadron (OMS), 4252nd OMS, and the 42nd Bomb Wing during the Vietnam Conflict. The applicant's complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The PUC is awarded to units of the United States Armed Forces for outstanding performance in action against an armed enemy occurring on, or after 7 Dec 41, for United States Air Force units. The unit must have displayed such gallantry, determination, and espirit de corps in accomplishing its mission under extremely difficult and hazardous conditions to have set it apart and above other units participating in the same campaign. The applicant’s DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, reflects the applicant enlisted in the Regular Air Force on 20 Jul 68. The AF Form 7, Airman Military Record, reflects he had foreign service in Okinawa. The applicant was released from active duty on 19 Jun 72 with an honorable discharge. He was credited with four years of active service, which included one year of foreign service. On 10 Nov 11, AFPC/DPSIDRA notified the applicant of his entitlement to the Air Force Outstanding Unit Award with Valor and one Bronze Oak Leaf Cluster (AFOUA w/V & 1BOLC), Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P), Vietnam Service Medal with two Bronze Service Stars (VSM w/2BSS), Air Force Longevity Service Award (AFLSA), and Air Force Good Conduct Medal (AFGCM). _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial of the applicant’s request for award of the PUC. After a thorough review of the applicant's official military personnel record, they were unable to verify he was assigned to any unit that was awarded the PUC during his term of service. The complete AFPC/DPSID evaluation is attached at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Aug 12, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting award of the PUC. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our decision the applicant is not the victim of an error or injustice.
