RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-01775 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: The 18 days of leave she lost in the beginning of fiscal year (FY) 2011 be restored. ________________________________________________________________ APPLICANT CONTENDS THAT: Finance did not process her leave from Jul 2010, until Oct 2011. Because of this she lost 18 days of leave. In support of her request, the applicant provides copies of her DFAS Forms 702, Defense Finance and Accounting Service Military Leave and Earnings Statement, and a screen shot of from the Air Force Financial Leave Request and Approval System. Her complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of master sergeant (MSgt, E-7). According to the information provided by the Air Force office of primary responsibility the applicant carried forward 63.5 days of leave at the beginning of FY 2010. She earned 30 days of leave, and used 34 days of leave during FY 2010. She carried forward 63.5 days of leave at the beginning of FY 2011, earned 30 days of leave, and used 37 days of leave during FY 2011. The applicant's leave balance at the beginning of FY 2011 was 56.5 days. ________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPSIM recommends denial. DPSIM states that in accordance with AFI 36-3003, Military Leave Program, Special Leave Accrual (SLA), members who are faced with circumstances that prohibit them from taking leave to accumulate leave in excess of 60 days (75 days until 30 Sept 2013). The situation preventing members from using leave must have been caused by a catastrophe, national emergency and/or crisis or operations in defense of national security. SLA shall not be used as a means to authorize the accumulation of leave in excess of 60 days that is a result of members' failure to properly manage their leave balance. The complete DPSIM evaluation is at Exhibit B. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 1 Oct 2012, for review and comment within 30 days (Exhibit C). As of this date, this office has not received a response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
