In support of his request, the applicant provides copies of his fitness history, and an extract from his medical records. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of technical sergeant (TSgt, E-6). ________________________________________________________________ THE AIR FORCE EVALUATION: AFPC/DPSIM recommends denial. DPSIM states that on 29 Jun 2012, a memorandum was sent to the applicant requesting additional documentation. Specifically, copies of his AF Form 469, Duty Limiting Condition Report; AF Form 422, Notification of Air Force Member's Qualification Status; AF Form 108, Physical Fitness Education and Intervention Processing, copies of his signed fitness score sheet and fitness questionnaire. The member did not provide the requested documentation. After further review of his fitness history, DPSIM states that he had a passing FA dated 3 Jan 2011, which was in between his failed FAs dated 4 Oct 2010 and 27 Jul 2011. He also passed his FA, dated 24 Oct 2011 while taking all four components of the FA. On 18 Apr 2012, he failed his FA while taking all four components. Three months later he was exempt from the cardio, push-up, and sit-up components of his FA dated 12 Jul 2012 and passed. The complete DPSIM evaluation is at Exhibit B. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 30 Oct 2012, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit C). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After thoroughly reviewing the evidence of record and noting the applicant’s contentions, we are not persuaded the contested FAs are in error or unjust. The medical documentation provided by the applicant is noted; however, it was rendered several months after the contested FAs. As such, this evidence does not persuade us that he had a duty limiting condition that prevented his successful completion of the contested Fas. Therefore, in the absence of evidence to the contrary, we find no basis to recommend favorable consideration of his request.. ________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. ________________________________________________________________ The following members of the Board considered this application in Executive Session on 24 Jan 2013, under the provisions of AFI 36-2603: XXXXXXX, Panel Chair XXXXXXX, Member XXXXXXX, Member The following documentary evidence pertaining to Docket number BC-2012-02595 was considered: Exhibit A.
