RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-02715 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His Air Force Achievement Medal (AFAM) is missing from his DD Form 214, Certificate of Release or Discharge from Active Duty. _________________________________________________________________ APPLICANT CONTENDS THAT: His AFAM was not documented in his official military personnel records or on his DD Form 214 at the time of his discharge. He does not want to misrepresent himself when he discloses his military accomplishments. The applicant's complete submission is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant served on active duty in the Regular Air Force from 20 Oct 89 to 29 Apr 92. His DD Form 214 reflects a total of 2 years, 6 months, and 10 days of total active service with 1 year, 11 months, and 15 days being Foreign Service. The AFAM was authorized by the Secretary of the Air Force on 20 Oct 80. It is awarded to Air Force personnel for outstanding achievement or meritorious service rendered specifically on behalf of the Air Force. It may also be awarded for acts of courage lesser than for award of the Air Force Commendation Medal. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial. DPSID states after a thorough review of the applicant’s official military personnel records, they were unable to locate a Special Order or citation to verify award of the AFAM. In addition, the applicant has not exhausted his administrative avenues for a retroactive request of the award. Retroactive recommendations for awards for retirees/veterans beyond the 2-year time limitation must be submitted in accordance with Title 10, Section 1130, United States Code (USC). The National Defense Authorization Act (NDAA) of Fiscal Year 1996 (FY96) passed Title 10, Section 1130 USC. The law allows for the submission of award recommendations (and the upgrading of previously approved awards) without regard to any previously imposed time constraints for submission if referred by a Member of Congress. The complete DPSID evaluation, with attachments, is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 23 Oct 12, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, a response has not been received by this office (Exhibit D). _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After a thorough review of the available evidence and the applicant’s complete submission, we are not persuaded that the AFAM should be added to his DD Form 214. The applicant has not provided any evidence to support his contentions that he was awarded the AFAM.
