RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-02937 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His record be corrected to reflect he was awarded the Global War on Terrorism - Expeditionary Medal (GWOT-E) ________________________________________________________________ APPLICANT CONTENDS THAT: He deployed after 9/11 in support of Operation ENDURING FREEDOM. He was the deployed Mission Support Commander and in charge of everything except flying and maintenance. His squadrons provided support for the aircraft flying over GWOT and Operation ENDURING FREEDOM missions. The GWOT-E was not approved when he completed his retirement forms. He was told to request the medal after retirement. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Air Force who served from 19 February 1978 to 30 September 2004 when he was honorably retired. AFPC/DPSID reviewed the applicant’s records and verified his entitlement to the Global War on Terrorism Service Medal. Additionally, they determined the applicant’s DD Form 214 should reflect he was awarded the Korean Defense Service Medal vice the Korean Service Medal. They will administratively correct his records, accordingly. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial. The GWOT-E is awarded to service members who have deployed abroad to specific geographic areas of eligibility in support of the Global War on Terrorism operations after 11 September 2001, to a future date to be determined for 30 consecutive days or 60 non-consecutive days. The Area of Eligibility (AOE) in general encompasses all foreign land, water and air spaces outside the 50 United States and outside 200 nautical miles of the shores of the United States. When recommended by the Chairman Joint Chiefs of Staff, the Under Secretary of Defense for Personnel and Readiness shall designate the specific AOE per qualifying operation. The Defense Finance and Accounting Service confirmed the applicant’s service in Japan from 1 October 2001 to 30 September 2004 and a deployment from 11 September 2001 to 30 September 2001; however, no location was provided. Additionally, no official documentation could be located to verify the applicant deployed to any area of eligibility for the award of the GWOT-E. There is insufficient evidence to support the applicant meets the requirements for the GWOT-E. The complete DPSID evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 11 September 2012, for review and comment within 30 days (Exhibit D). As of this date, this office has received no response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting award of the GWOT-E. We took notice of the applicant's complete submission and the available evidence of record in judging the merits of the case; however, we find that he has not met his burden of establishing that he meets the eligibility requirements for the GWOT-E. Therefore, in the absence of evidence to the contrary, we find no basis to grant the relief sought in this application.
