RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-04029 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. His final Permissive Temporary Duty (PTDY) dates be corrected to reflect 28 Nov 11 to 27 Dec 11. 2. His terminal leave dates be corrected to reflect 28 Dec 11 to 31 Dec 11. 3. Any excess leave be sold back to the Air Force based on the Joint Base Pearl Harbor-Hickam (JBPHH), Hawaii rates. APPLICANT CONTENDS THAT: Finance was unable to correct his PTDY and terminal leave dates because his finance records were inactive. In support of his request, the applicant provides copies of his AF IMTs 988, Leave Request/Authorization, and a memorandum dated 22 Mar 12.. The applicant’s complete submission, with attachments is at Exhibit A. STATEMENT OF FACTS: The applicant’s military personnel records indicate he enlisted in the Regular Air Force on 3 Dec 85 and retired from active duty, effective 1 Jan 12. According to the Defense Finance and Accounting Service (DFAS) records, the applicant was on PTDY from 21 Nov 11 through 20 Dec 11 and was charged terminal leave from 21 Dec 11 through 31 Dec 11. On 30 Oct 12, AFPC/DPSIM requested additional documentation from the applicant, specifically, a letter signed by his squadron commander stating his PTDY and terminal leave dates were changed prior to retirement due to operational mission requirements. In a letter dated 16 Jul 13, the Air Force Board for Correction of Military Records (AFBCMR) administratively closed the applicant’s case because he did not indicate how he wanted his PTDY and terminal leave dates corrected. The AFBCMR also advised that he had not provided adequate source documents (i.e., AF Form 988) that would aid the Board in surmising his request. On 7 Nov 13, the applicant resubmitted his application and provided two AF IMTs 988 and a letter from his unit indicating the change to his PTDY and terminal leave dates were due to administrative duties in his workplace. According to the AF IMT 988, dated 18 Nov 11, his PTDY started on 28 Nov 11 and ended on 27 Dec 11. According to the AF IMT 988, dated 18 Nov 11, his terminal leave started on 28 Dec 11 and ended on 31 Dec 11. AIR FORCE EVALUATION: AFPC/DPSIM recommends approval. Finance is responsible for processing PTDY in conjunction with terminal leave. The applicant’s finance office has acknowledged the administrative error. The complete DPSIM evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 25 Jan 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. As a result of the recommended corrections to his record, he will be paid for seven days of leave based on the JBPHH’s rate as requested. Therefore, we recommend the applicant’s record be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT, be corrected to show that: a. His Permissive Temporary Duty (PTDY) dates in conjunction with his retirement, effective 1 January 2012, be corrected to reflect 28 November 2011 through 27 December 2011. b. His terminal leave dates in conjunction with his retirement, effective 1 January 2012, be corrected to reflect 28 December 2011 through 31 December 2011.
