RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-04122 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His official records be changed to show that he timely elected Career Status Bonus (CSB). ________________________________________________________________ APPLICANT CONTENDS THAT: The request for the CSB was rejected because he was provided erroneous guidance. His local Military Personnel Flight (MPF) misinformed him by telling him he only needed to return his CSB election within three days of his attaining 15 years of total active service. He was also told via telephone they could not process the election prior to that same date. He submitted his request at the end of Jul 12 in accordance with the guidance he received; however, his application was denied because he didn’t make his election within the six month notification window. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant initially entered the Air Force on 30 Jul 97, and surpassed 15 years of active service on 30 Jul 12. The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility which is included at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSOR recommends denial, indicating there is no evidence of an error or an injustice. There is a 6 Jan 12 Notification of CSB Redux Eligibility Memorandum in the applicant’s personnel files, indicating he was notified of his CSB eligibility and that he must initiate his election within six months of the notification. By initialing the notification memo the applicant indicated he understood he had until 6 Jul 12 to make an election and return the completed DD Form 2839, Career Status Bonus (CSB) Election, to the MPF. The applicant did not return the DD Form 2839 until 30 Jul 12. Therefore, he is no longer eligible for the CSB. A complete copy of the AFPC/DPSOR evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 16 Oct 12 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. While the applicant has provided copies of email traffic indicating that local personnel officials advised him incorrectly, the evidence of record indicates the applicant was previously officially notified of his rights and obligations under the CSB and that he needed to make an election within six months of the date of the notification letter.
