RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-04151 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His fitness assessment (FA), dated 2 August 2012, be removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: He was not medically fit to complete the walk, run, push-ups or sit-ups for his 2 August 2012, FA. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Staff Sergeant (SSgt), E-5. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: 1. AFPC/DPSIM recommends partial approval. DPSIM states that the applicant asserts that he had a medical condition which precluded him from receiving a passing FA score. On 6 August 2012, it was determined that his current profile needed modification due to his unstable medical condition. 2. On 20 September 2012, a memorandum was sent to the applicant requesting additional documentation be submitted within 30 days to substantiate his claim. Specifically, a copy of his AF Form 422, Notification of Air Force Member’s Qualification Status, documenting limitations and exemptions, a signed FA score sheet, and fitness questionnaire. 3. The applicant provided an AF Form 469, Duty Limiting Report dated 17 May 2012 (modified 8 August 2012) stating no repetitive bending at the waist, no lifting greater than 10 lbs., no running greater than 100 yards and no pushing or pulling greater than 10 lbs. They recommend the cardio, push-up, and sit-up components of the FA dated 2 August 2012, be updated to reflect exempt in AFFMS. The applicant's overall composite score will reflect 100.00 (Excellent). The complete AFPC/DPSIM evaluation, with attachments, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 November 2012 for review and comment within 30 days (Exhibit D). To date, a response has not been received. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice with respect to the applicant’s request for removal of the entire contested FA. After thoroughly reviewing the evidence of record and noting the applicant's contentions, we are not persuaded the entire contested FA is in error or unjust. The AF Form 469, Duty Limiting Report, documenting his limitations and duty exemptions and the Military Medical Provider’s assessment is noted; however, in the absence of documentation indicating the applicant should have been exempt from completing the FA, we find insufficient evidence to warrant removal of the entire FA. 4. Notwithstanding our determination above, sufficient relevant evidence has been presented to demonstrate the existence of error or injustice to warrant partial relief. The Board notes the Air Force office of primary responsibility recommends partial approval based on the Military Medical Provider’s determination that the applicant’s current profile needed to be modified due to his unstable medical condition. Based on the medical provider’s assessment, we believe the cardio, push-ups and sit-ups components of the contested FA should be corrected to reflect “exempt” in the AFFMS. Our recommended change will result in an overall composite fitness score of 100.00, (Excellent).
