RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-04537 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect his foreign service time. ________________________________________________________________ APPLICANT CONTENDS THAT: He served overseas during his active service and received the Southwest Asia Service Medal with one Oak Leaf Cluster (SWASM w/1OLC). The applicant’s complete submission, with attachment, is at Exhibit A. _________________ ______________________________________________ STATEMENT OF FACTS: The applicant initially entered the Air Force on 7 Mar 90. The DD Form 214, issued in conjunction with his 28 Sep 94 honorable discharge reflects that he was credited with 4 years, 6 months, and 22 days of total active service, but no foreign service. According to the Defense Finance and Accounting Service (DFAS), the applicant’s financial records reflect that he entered the combat zone (CZ) in Saudi Arabia on 14 Oct 91 and departed the CZ 3 months and 18 days later on 31 Jan 92. The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility (OPR) which is included at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends approval, indicating there is evidence of an error. A review of the applicant’s Master Personnel Records and documentation submitted indicates the applicant volunteered for duty in Saudi Arabia as part of Operation DESERT STORM; however, the overseas duty is not reflected in his personnel records. Recommend the board review the documentation and determine the appropriate amount of foreign service credit to award the applicant. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 10 Dec 12 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion of AFPC/DPAPP that the applicant served in Saudi Arabia during Operation DESERT STORM and adopt its rationale as the basis for our conclusion that relief should be granted. We note DFAS reviewed the applicant’s financial records, and has confirmed the applicant received foreign duty pay for 90 days during the period 14 Oct 91 through 11 Jan 92. Therefore, we recommend the applicant’s record be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that Block 12f, Foreign Service, of his DD Form 214, Certificate of Release or Discharge from Active Duty, issued in conjunction with his 28 Sep 94 separation, be amended to reflect 3 months and 18 days. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2012-04537 in Executive Session on 25 Jun 13, under the provisions of AFI 36-2603: Panel Chair Member Member All members voted to correct the records as recommended.
