Her 16 November 2010, 14 February 2011, 5 January 2012, 3 April 2012, and 2 July 2012 Fitness Assessment (FA) scores be declared void and removed from the Air Force Fitness Management System (AFFMS). 2. Her Referral Enlisted Performance Report (EPR), rendered for the period 17 November 2009 through 16 November 2010, be declared void and removed from her records. 3. Her records be corrected to reflect she was promoted to the grade of master sergeant (E-7), effective 1 December 2010, instead of 1 August 12. ________________________________________________________________ APPLICANT CONTENDS THAT: 1. Her FA failures were the result of documented multiple medical conditions. 2. Her Referral EPR was rendered as a result of her FA failures, causing her to be ineligible for promotion and her line number to be removed. 3. Her promotion to master sergeant (E-7) during promotion cycle 10E7 should be reconsidered because a medical provider determined that her medical conditions were a contributing factor to her 16 November 2010 FA failure. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant’s military records indicate that she served in the Regular Air Force in the grade of technical sergeant (E-6) prior to the events under review. The applicant was restricted from running greater than one half mile, walking greater than two miles, pushing greater than 40 pounds, repetitive bending of the waist, and strenuous activity, until 4 November 2010. On 27 July 2010, the applicant was issued an AF Form 422, Notification of Air Force Member’s Qualification Status, which exempted her from all components of the FA, except for the abdominal circumference (AC) component, until 4 November 2010. On 18 October 2010, the applicant was issued an AF Form 422, which exempted her from the 1.5 mile run and 1.0 mile walk, until 2 November 2010. On 10 November 2010, the applicant was issued an AF Form 422, which exempted her from the 1.5 mile run and 1.0 mile walk, until 30 November 2010. On 30 November 2010, the contested EPR was rendered upon the applicant, which contained comments that made the report a referral; specifically, a comment in section 3 pertaining to her poor fitness score. The applicant was tentatively selected for promotion to the grade of master sergeant (E-7) during cycle 10E7. She received promotion sequence number (PSN) 1682.0, which would have incremented on 1 December 2010. However, her promotion was deferred in accordance with AFI 36-2502, Airman Promotion Program, when she received the aforementioned referral EPR. On 7 February 2011, the applicant was issued an AF Form 422, which exempted her from the 1.5 mile run and 1.0 mile walk, until 18 February 2011. On 18 April 2011, an AF Form 469, was initiated that restricted the applicant’s duty and mobility. The applicant was restricted from running, no max effort bending at the waist, jumping, squatting, pushing, or pulling with upper body greater than 40 pounds, until 15 May 2011. On 11 September 2011, an AF Form 469, was initiated that restricted the applicant’s duty. The applicant was restricted from running greater than 100 yards, jumping, squatting, pushing/pulling, lifting greater than 40 pounds, or repetitive bending at the waist, until 22 September 2011. On 1 November 2011, an AF Form 469, was initiated that restricted the applicant’s duty. The applicant was restricted from running greater than 100 yards, walking greater than one quarter mile, marching, squatting, high impact activity, pushing/pulling or lifting greater than 40 pounds, until 30 November 2011. On 19 December 2011, an AF Form 469, was initiated that restricted the applicant’s duty. The applicant was restricted from running greater than 100 yards, repetitive bending at the waist, marching, squatting, high impact activity, and pushing/pulling or lifting greater than 40 pounds, until 14 February 2012. On 21 December 2011, the applicant was issued an AF Form 422, which exempted her from all components of the FA, except for her abdominal circumference (AC) assessment, until 14 February 2012. On 2 March 2012, the applicant was issued an AF Form 422, which exempted her from all components of the FA, except for her abdominal circumference (AC) assessment, until 20 April 2012. On 10 April 2012, an AF Form 469, was initiated that restricted the applicant’s duty and mobility. The applicant was restricted from running greater than 100 yards, lifting/pulling or pushing greater than 40 pounds, high impact activity, and repetitive bending at the waist, until 20 February 2013. On 1 June 2012, an AF Form 469, was initiated that restricted the applicant’s duty and mobility. The applicant was restricted from running greater than 100 yards, lifting/pulling or pushing greater than 40 pounds, high impact activity, and repetitive bending a the waist, until 20 February 2013. On 6 June 2012, the applicant was issued an AF Form 422, which exempted her from all components of the FA, except for her abdominal circumference (AC) assessment, until 20 February 2013. On 10 June 2012, the applicant’s medical provider indicated on an AF Form 108, Physical Fitness Education and Intervention Processing, that she is and has been on multiple medications to cause unwanted weight gain. On 11 July 2012, the applicant’s medical provider indicated on an AF Form 108, that she has multiple reasons that she would not be able to pass a physical training test. On 1 August 2012, the applicant was promoted to the grade of master sergeant (E-7). On 21 August 2012, the applicant’s medical provider indicated that she had a documented medical condition that precluded her from achieving a passing score in the non-exempt portions of her 14 February 2011, 5 January 2012, 3 April 2012, and 02 July 2012 FA tests. On an undated letter, the applicant’s medical provider indicated that she had a documented medical condition that precluded her from achieving a passing score in a non-exempt portion of her 16 November 2010 FA tests. On 28 March 2013, the applicant was relieved from active duty and permanently retired for physical disability, effective 29 March 2013, with a combined compensable disability rating of 40 percent. The applicant was credited with 18 years, 7 months, and 12 days total active service for retirement. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends approval of the applicant’s request to have her 16 November 2010, 14 February 2011, 5 January 2012, 3 April 2012, and 2 July 2012 Fitness Assessments removed from the Air Force Fitness Management System (AFFMS) because she had documented medical conditions that precluded her from achieving passing scores in non-exempt portions of the contested FAs. A complete copy of the AFPC/DPSIM evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 February 2013 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s requests related to her fitness assessments (FA). We took notice of the applicant’s complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant’s contested FAs should be declared void and removed due to her medical conditions. As for the applicant’s request to remove her referral enlisted performance report (EPR) and restore the original effective date of her promotion to the grade of master sergeant, in view of the fact that we have determined the contested FA scores should be removed, and the applicant’s FA failure formed the sole basis of the referral EPR and promotion deferral, we believe it would be appropriate to recommend approval of the applicant’s remaining requests. Therefore, we recommend the applicant’s records be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that: a. Her 16 November 2010, 14 February 2011, 5 January 2012, 3 April 2012, and 2 July 2012 Fitness Assessments (FA) be declared void and removed from the Air Force Fitness Management System (AFFMS). b. The AF Form 910, Enlisted Performance Report (AB thru TSgt), rendered for the period 17 November 2009 through 16 November 2010, be declared void and removed from her records. c.
