ADDENDUM TO RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2012-05184-2 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect his name as XXX XXX and he be issued a DD Form 215, Correction to DD Form 214. RESUME OF CASE: On 22 August 2013, the Board considered and denied the applicant’s request to correct his records to reflect his name as XXX XXX to receive medical treatment from the Veteran’s Affair Medical Center. The Board found his name as reflected in his records was not recorded in error. For an accounting of the facts and circumstances surrounding the applicant’s request and the rationale of the earlier decision by the Board, see the Original Record of Proceedings. On 27 September 2013, the applicant submitted a request for reconsideration. The applicant contends his name was changed on 26 January 1983. As new evidence in support of his request, he submits an amended birth certificate. The applicant’s complete submission, with attachment, is at Exhibit G. On 28 February 2014, AFPC/DPSIRP issued an AF IMT 281, Notification of Change in Service Members Official Records, reflecting the applicant’s name change in his official records to XXX XXX (Exhibit H). AIR FORCE EVALUATION: AFPC/DPSOR recommends denial of changing the applicant’s DD Form 214, Certificate of Release or Discharge from Active Duty Service. During the applicant’s period of active duty service from 20 August 1965 to 15 January 1969, he signed and certified all documents as XXX XXX. On 26 January 1983, his birth certificate was changed to reflect XXX XXX based on use as an alias. AFI 36-3202, Separation Documents, is the governing directive for the DD Form 214 and directs the name on the DD Form 214 be recorded as listed on the military members DD Form 4, Enlistment/Reenlistment Document-Armed Forces of the United States. A review of the applicant’s reenlistment reflects XXX XXX and remained that until the DD Form 214 was published on 15 January 1969. For instances where a name change is effective after the date of publication of a DD Form 214, the member shows the agency providing the benefit any and all legal documentation to explain such a change. This situation is not unique. The recognized use of an alias does not constitute a change to a DD Form 214. The applicant has not provided evidence that the documents he signed throughout his military career or DD Form 214 were prepared in error. The complete AFPC/DPSOR evaluation is at Exhibit I. APPLICANT’S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 20 June 2014, for review and comment within 30 days (Exhibit J). As of this date, this office has received no response. THE BOARD CONCLUDES THAT: In earlier findings, the Board determined that there was insufficient evidence to warrant any corrective action. After thoroughly reviewing the additional documentation submitted in support of his appeal and the evidence of record, we do not believe the applicant has overcome the rationale expressed in our previous decision. While AFPC/DPSIRP has issued a change to the official record, we do not find the DD Form 214 was recorded in error. Therefore, in view of the above, and in the absence of evidence to the contrary, we find no basis upon which to recommend favorable consideration of the applicant’s request. ________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
