The Vietnam Campaign Medal (VCM). (Administratively Corrected) 2. The Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P). (Administratively Corrected) 3. The National Defense Service Medal (NDSM). (No Action Required) 4. The Air Force Outstanding Unit Award with Valor and two Bronze Oak Leaf Clusters (AFOUA w/V &2BOLC). (Administratively Corrected) 5. The Good Conduct Medal (GCM). ___________________________________________________________________ THE APPLICANT CONTENDS THAT: He believes he is entitled to the requested awards; however, he has not received these awards for his service from 27 Jul 70 to 26 Apr 74. Also, his service includes a one year tour of duty at Ubon RTAFB from Oct 72 through Oct 73 and service in support of Operation Linebacker II. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force, on 27 Jul 70, for a period of four years. His AF Form 7, Airman Military Record, indicates the applicant was awarded the VSM and the RVCM. The applicant served with the 8th Organizational Maintenance Squadron, Ubon Air Field, Thailand, from 1 Oct 72 to 2 Oct 73. The 8th Organizational Maintenance Squadron received award of the AFOUA, w/V with award inclusive period of 28 Jan 73 to 15 Aug 73. On 29 Apr 74, he was honorably released from active duty, under the provisions of AFR 39-10, Separation for the Convenience of the Government. He was credited with 3 years, 9 months, and 3 days of active duty service, including 1 year of foreign service. The applicant’s DD Form 214 included award of the NDSM and the Air Force Good Conduct Medal (AFGCM). On 26 Mar 04, the applicant’s DD Form 214 was administratively corrected to reflect award of the VSM. The applicant’s record will be administratively corrected to reflect award of the VCM, RVNGC w/P, and the AFOUA w/V &2BOLC. ________________________________________________________________ THE AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial for award of the Good Conduct Medal. The applicant's dates of service render him ineligible for award of the Good Conduct Medal. Due to the applicant's dates of service he qualifies for award under the criteria established for the Air Force Good Conduct Medal verses the Good Conduct Medal. The Air Force Good Conduct Medal is annotated on the applicants DD Form 214; therefore, no action is required. After a thorough review of the applicant's official military personnel record, they were able to verify award of the VCM, RVNGC w/P, and the AFOUA w/V & 2BOLC. The complete AFPC/DPSIDR evaluation, with attachments, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 24 Feb 13 for review and comment within 30 days (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice for award of the Good Conduct Medal. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted.
