RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-00371 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be amended to include Vietnam service. ________________________________________________________________ _ APPLICANT CONTENDS THAT: He is not able to apply for a presumptive Agent Orange evaluation for ischemia heart disease. The Department of Veterans Affairs investigation indicated that he did not have “in country” service in Vietnam. In support of the applicant’s appeal, he provides copies of documents extracted from his military personnel records. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: On 30 September 1983, the applicant was released from active duty and on 1 October 1983, he retired in the grade of master sergeant under the provisions of AFR 35-7 (Voluntary-Retirement for years of service established by law). He served 27 years, 1 month and 8 days on active duty and credited with 15 years, 10 months and 27 days of foreign service. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. DPAPP states they were able to verify and confirm boots on the ground in Thailand, but not Vietnam. A review of his master personnel records and documentation submitted failed to provide any documents that substantiate foreign service time in Vietnam. The DPAPP complete evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant states that the orders he provided reflect that he was relieved from assignment with the 2054th Communications Squadron and assigned to the 1964th Communications Group, APO 143, Saigon, Vietnam. He departed CONUS and arrived in Tan Son Nhut, Saigon on 13 December 1964. He processed into the 1964th Communications Group and was assigned as an Air Traffic Control Radar Repairman. Upon arrival at Tan Son Nhut he received payment for his travel and permanent change of station (PCS) move. On 22 December 1964, he departed Tan Son Nhut for Thailand after serving approximately nine days in Vietnam. He further states award of the Air Force Outstanding Unit award is proof that he was assigned to and served in Vietnam. The applicant’s complete response, with attachments, is at Exhibit F. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. The applicant’s contentions are duly noted; however, after reviewing the evidence of record, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not provided sufficient evidence to substantiate time served in Vietnam.
