RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-00987 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: He be allowed to transfer his Post-9/11 GI Bill Transfer of Educational Benefits (TEB) to his dependents effective 16 April 2012 or in the alternative his date of separation (DOS) be amended to reflect 1 July 2014. ________________________________________________________________ _ APPLICANT CONTENDS THAT: He was assigned to a geographically separated unit without .mil access. He obtained retainability, delayed his retirement specifically for the TEB on 16 April 2012 and submitted the application in a timely manner; however, there is no record of the SOU. He was not notified on 1 May 2012 that there were any issues with the application. In support of the applicant’s appeal, he submits a copy of his Statement of Understanding, email communique, documents extracted from his military personnel records and other documentation. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The applicant is currently serving on active duty in the grade of senior master sergeant. Any member of the Armed Forces on or after 1 August 2009, who, at the time of the approval of the individual's request to transfer entitlement to educational assistance under this section, is eligible for the Post-9/11 GI Bill, has at least 6 years of service in the Armed Forces (active duty and/or Selected Reserve) on the date of election and agrees to serve a specified additional period in the Armed Forces from the date of election. The remaining relevant facts pertaining to this application, extracted from the applicant’s military records, are contained in the letter prepared by the appropriate office of the Air Force at Exhibit B. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSIT recommends approval. DPSIT states they recommend approving the TEB for 16 April 2012 with an applicable ADSC/Obligation to 15 April 2016. The applicant was assigned to a geographically separated unit without .mil access. The applicant did not discover the error until an audit was completed and sent to him on 15 February 2013. The DPSIT complete evaluation is at Exhibit B. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 15 March 2013, a copy of the Air Force evaluation was forwarded to the applicant for review and response within 30 days (Exhibit C). As of this date, no response has been received by this office. ________________________________________________________________ _ THE BOARD CONCLUDES THAT 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case and agree with the assessment and recommendation of AFPC/DPSIT.
