RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-01228 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His record be corrected to reflect his active duty service commitment (ADSC) date as of December 2009 when he originally submitted his Post-9/11 GI Bill transfer of educational benefits (TEB) request. ________________________________________________________________ APPLICANT CONTENDS THAT: He applied for the Post-9/11 GI Bill TEB in December 2009 while deployed to Afghanistan. The message he received after submitting the online application indicated the transfer had been completed. However, nearly three years later, he received an email informing him that an audit had detected that he needed to sign and send in a statement of understanding (SOU) for the Post-9/11 GI Bill TEB to be complete. He did that, but the ADSC was based on the recent date he signed the SOU. He requests the Board correct the ADSC so that it is based on the date the application was created in December 2009. In support of his request, the applicant provides a copy of an email message pertaining to his TEB, a 1 March 2013 letter of approval for the TEB, and recognition documents pertaining to his deployment. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Colonel, O-6. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIT recommends approval. DPSIT states during the period from 1 August 2009 to 1 July 2010, there was no “banner” in the virtual Military Personnel Flight (vMPF) which allowed members to verify their email and phone numbers prior to continuing. It is possible with the applicant’s temporary duty (TDY) assignment and this lack of verification, that he did not receive notification. The complete AFPC/DPSIT evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 22 March 2013, for review and comment within 30 days (Exhibit D). To date, a response has not been received. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we are persuaded that relief is warranted. In this respect, we note the applicant has provided documentation substantiating he applied for the Transfer of Educational Benefits (TEB) for his dependents. We also note the comments of the Air Force office of primary responsibility indicating it is possible that with the applicant’s temporary duty (TDY) assignment and a lack of verification in the virtual Military Personnel Flight (vMPF), he did not receive notification. In view of this and noting the applicant did take affirmative action to transfer his educational benefits, we find a sufficient basis to conclude that he has been the victim of an injustice and therefore, recommend the records be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that: a. On 4 December 2009, he elected to transfer his Post-9/11 GI Bill Educational Benefits (TEB). b.
