RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-01275 XXXXXXX COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: Her nonselection for promotion to the grade of major while assigned to the Individual Ready Reserve (IRR) be removed. ________________________________________________________________ APPLICANT CONTENDS THAT: The reason surrounding her nonselection for promotion to the grade of major is unclear; however, she believes it is because the selection board was not aware of her Master’s Degree or Squadron Officer School (SOS) that she completed while on active duty. She was advised that she had been passed-over twice while being interviewed for a Bioenvironmental Engineering position vacancy with the Montana Air National Guard (MT ANG). In support of her appeal, the applicant provides a personal statement and copies of her transcript for completion of her Master’s Degree (MS Degree) program and SOS. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant was considered, but not selected, for promotion to the grade of major by the Calendar Year 2010 (CY10) and the CY11 Line and Nonline Nonparticipating Reserve (NPR) Major Promotion Selection Boards, that convened 31 Jan 10 and 23 Jan 11, respectively. The quota for nonparticipating major boards was one (1) for each board. On 1 Oct 11, the applicant was discharged under the provisions of Title 10, United States Code 14505 and 14513 for two nonselections for promotion to the grade of major. ________________________________________________________________ THE AIR FORCE EVALUATION: ARPC/PB recommends denial, stating in part, that while there may have been an error in the applicant’s advanced academic education information, in accordance with AFI 36-2504, Promotion, Continuation, and Selective Early Removal in the Reserve of the Air Force, paragraph 1.7., it was her responsibility to update that data and ensure it was current before her record was considered by each board. In addition, the applicant was assigned to the IRR from 11 Jan 07 through 30 May 11. During this time she completed her military service obligation and her 3 year contractual commitment for accepting separation pay (Title 10 U.S.C. Section 1174). On 31 May 11, she was assigned to the Inactive Status List Reserve Section (ISLRS), and discharged effective 1 Oct 11 for being nonselected twice for promotion (Title 10 U.S.C. Section 14505 and 14513). A review of the applicant's Officer Selection Record (OSR) and Officer Selection Briefs (OSB) reveals that the Masters of Science Degree was not reflected in her record, while the completion of Basic Developmental Education was reflected in her record. Upon completion of an academic degree, the member must supply HQ Air Force Institute of Technology (AFIT) a transcript from the university that conferred the degree. Only HQ AFIT can update this information. The complete PB evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: The applicant notes that, “To be clear, it is necessary that just one "non-select" be removed from her military records in order to make her eligible for commissioning into the Air National Guard. She will promptly provide her official transcripts to the appropriate office at AFIT and update her records to reflect the completion of her master's degree. She discovered this error just recently while in the final stages of hiring by the MT ANG. Until this point, it seemed reasonable to conclude that AFIT would have a record of a degree she completed while on active duty and assigned to AFIT itself. She submitted a request to have her official graduate school transcript sent to the AFIT Academic Coding Branch to correct her previous oversight. It is her strong desire to serve again as an officer in the MT ANG and there is a vacant position for which she is qualified. She urges the Board to consider taking the actions included in Paragraph 5 of the Air Force Reserve evaluation to remove one nonselection to major from her records so that she might have this opportunity. The applicant’s complete response is at Exhibit E. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We note that the applicant requests her nonselection to the grade of major be removed; however, as pointed out by ARPC/PB, it was the applicant’s responsibility to ensure her records were current and we do not find that she exercised due diligence in ensuring her records were current and up to date. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. .
