RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-01694 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Separation from Active Duty, be corrected to reflect award of the Presidential Unit Citation with Bronze Oak Leaf Cluster (PUC w/BOLC) and any other awards that he may be entitled to. ________________________________________________________________ APPLICANT CONTENDS THAT: While he was trying to join the Veterans of Foreign Wars (VFW), he was told that his DD Form 214 did not reflect any foreign service time. He believes this to be in error or unjust because from April 1973 through April 1974 he served at U-Tapao Thailand under the 307th Munitions Maintenance Squadron loading bombs onto B52s. In support of his request, the applicant provides personal statements, a copy of a printout from the internet, a copy of his NGB Form 22, Report of Separation and Record of Service in the Air National Guard of Illinois, and a copy of his DD Form 214. His complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant’s DD Form 214 reflects he has 1 year of foreign service and a total of 2 years and 10 days of total service for pay. The applicant was discharged from the National Guard Bureau (NGB) on 11 Mar 79 in the grade of sergeant. The applicant’s DD Form 214 was previously corrected to reflect the VSM (DD Form 215, Correction to DD Form 214, Report of Separation from Active Duty), see Exhibit B. AFPC/DPSOR was able to verify the applicant’s entitlement to the Air Force Good Conduct Medal (AFCM) and the Air Force Outstanding Unit Award (AFOUA) and his record will be administratively corrected. The PUC criteria: Executive Order 9075 on 26 Feb 42, created this award and was superseded by Executive Order 9396 on 2 Dec 43, which authorized the Distinguished Unit Citation, and this executive order was superseded by Executive Order 10694, on 10 Jan 57 which redesignated the Distinguished Unit Citation as the Presidential Unit Citation. It is conferred on units of the armed forces of the United States and of cobelligerent nations, for extraordinary heroism in action against an armed enemy on or after 7 Dec 41. The unit must display such gallantry, determination, and esprit de corps in accomplishing its mission as to set it apart from and above other units participating in the same campaign. The degree of heroism required is the same as that which would warrant award of the Distinguished Service Cross to an individual. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is at Exhibit C. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSID recommends denying award of the PUC stating they were unable to verify that the applicant’s unit of assignment or attachment at that time was awarded the PUC; therefore, rendering him ineligible for the award. The complete DPSID evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 10 Jul 13 for review and comment within 30 days. As of this date, this office has received no response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took note of the applicant’s complete submission; however, we do not find he has provided sufficient documentary evidence to substantiate his claim that his unit was awarded the PUC; therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted.
