RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-01955 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect award of the Armed Forces Service Medal (AFSM). ________________________________________________________________ APPLICANT CONTENDS THAT: Based on the documentation that he has in his possession, he believes he is eligible for this award. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant’s military personnel records indicate that he enlisted in the Regular Air Force on 20 Aug 84 and served on active duty until 31 Aug 04, when he was relieved of active duty and retired. He was credited with 20 years and 11 days of total active service, which included 5 years, 10 months, and 27 days of foreign service. The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility, which is attached at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial, indicating they were unable to verify the applicant served in a Department of Defense approved operation for award of the AFSM. The AFSM is awarded to members of the Armed Forces of the United States who, after 1 Jun 92; participated, or have participated, as members of the United States military units, in a United States military operation that is deemed to be a significant activity by the Joint Chiefs of Staff; and encounter no foreign armed opposition or imminent threat of hostile action. A review of the applicant’s records revealed that he should have been awarded the Meritorious Unit Award (MUA), Global War on Terrorism Expeditionary Medal (GWOT-E), Global War on Terrorism Service Medal (GWOT-S), Korean Defense Service Medal (KDSM), and the Air Force Expeditionary Service Ribbon with Gold Border and one Bronze Oak Leaf Cluster (AFESR w/GB & 1BOLC) and his official military personnel records will be administratively corrected by AFPC/DPSOR. A complete copy of the AFPC/DPSID evaluation, with attachment is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 24 Jul 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s request for the Armed Forces Service Medal (AFSM). We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. We note the Air Force OPR has verified the applicant’s entitlement to the Meritorious Unit Award (MUA), Global War on Terrorism Expeditionary Medal (GWOT-E), Global War on Terrorism Service Medal (GWOT-S), Korean Defense Service Medal (KDSM), and the Air Force Expeditionary Service Ribbon with Gold Border and one Bronze Oak Leaf Cluster (AFESR w/GB & 1BOLC) and corrected his records administratively.
