RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-02015 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to reflect his Distinguished Flying Cross (DFC) award. _________________________________________________________________ APPLICANT CONTENDS THAT: He received the DFC after being discharged from the Air Force and would like his DD Form 214 amended to include the DFC. He misplaced the original DFC medal and would like a replacement medal. He only realized the DFC was not reflected on his DD Form 214 when he requested the medal to be replaced. In support of his request, the applicant provides a copy of a National Personnel Records Center letter, a copy of the awards transmittal, and a copy of his DFC citation. His complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant enlisted into the Regular Air Force on 8 Aug 66 and received an honorable discharge on 17 May 70 after serving 3 years, 8 months, and 10 days on active duty. The DFC was established in the Air Corps Act (Act of Congress, 2 July 1926, Public Law No. 446, 69th Congress). This act provided for award “to any person, while serving in any capacity with the Air Corps of the Army of the United States, including the National Guard and the Organized Reserves, or with the United States Navy, since the 6th day of April 1917, has distinguished, or who, after the approval of this Act, distinguishes himself by heroism or extraordinary achievement while participating in an aerial flight.” The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is at Exhibit C. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends approval stating that although the applicant’s records do not contain a citation or special order, based on the documentation provided by the applicant, it appears he did receive the DFC award. However, the award elements were not placed in his official military records. The complete DPSID evaluation is at Exhibit C. _________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 24 Jul 13 for review and comment within 30 days. As of this date, this office has received no response. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting correction of the applicant’s record to reflect the award of the DFC. We agree with the Air Force office of primary responsibility that based on the citation provided it appears the applicant did receive the DFC award. Therefore, we recommend his records be corrected as indicated below. _________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that the DD Form 214, Report of Separation from Active Duty, issued in conjunction with his 17 May 1970 separation, be and hereby is, amended in Item 24, Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized, to include the Distinguished Flying Cross (DFC). _________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2013-02015 in Executive Session on 12 Dec 13, under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the records, as recommended.
