RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-02688 COUNSEL: NONE XXXXXXX HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His Military Personnel Appropriation (MPA) orders be extended. ________________________________________________________________ APPLICANT CONTENDS THAT: His original tour of duty began on 27 Sep 2012 and was supposed to end on 14 Apr 2013. However, due to a lack of airlift he was not able to leave his temporary duty location on time. As a result, the combined rest and recuperation period and accrued leave exceeded the days built into the MPA authorization. His request to extend his MPA orders was declined due to the lack of a 180-day per-diem waiver and the fact that the request was submitted "after the fact." In support of his request, the applicant provides copies of Special Order TE-0006 and AF Form 938, Request and Authorization for Active Duty Training/Active Duty Tour. His complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is a Senior Airman (SrA, E-4) in the Air Force Reserve. He participated in Special Mission Travel from Hill AFB, UT to Kunsan AB, Republic of Korea via Special Order TE- 0006 issued on 5 Oct 2012. ________________________________________________________________ AIR FORCE EVALUATION: AFRC FGC/FCS recommends approval. FGC/FCS states that the applicant’s request for a military orders amendment following his 30 Sep 2012 through 19 May 2013 deployment should have included provisions for 4 days of compensatory time and up to 10 days of unscheduled personal time. Moreover AFI 36-3003, Military Leave Program, authorizes members 2.5 days of leave for each month of active duty. Based on the following analysis the applicant’s orders ending on 19 May 2013 should be amended to end on 27 May 2013: Travel Dates: 30 Sep 2012 to 22 Apr 2013. Post deployment Downtime Earned: 14 days. (22 Apr 2013 return date plus 14 days of downtime equates to 6 May 2013). Leave Earned: 21 days. (22 Apr 2013 return date plus 14 days of downtime plus 21 days of earned leave equates to 27 May 2013) There is a difference of 8 days (from original orders end date [19 May 2013] to 27 May 2013). The complete FGC/FCS evaluation is at Exhibit B. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 6 Sep 2013, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibits C). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant contends his request to extend his MPA orders was declined due circumstances beyond his control. After a thorough review of the evidence of record and the applicant’s complete submission, we believe it is in the interest of justice to recommend granting the requested relief. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Accordingly, we recommend his records be corrected as set forth below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that the AF Form 938, Request and Authorization for Active Training/Active Duty Tour, Reserve Order No. D5A14N, dated 20121004, Item 14, Release Date, be amended to read 20130527 rather than 20130519. ________________________________________________________________ The following members of the Board considered this application in Executive Session on 13 Mar 2014, under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the record as recommended.
