RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03121 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His record be corrected to reflect he was awarded the Good Conduct Medal (GCM). ________________________________________________________________ APPLICANT CONTENDS THAT: He was told he would receive his awards once he returned to the Continental United States. In support of his appeal, the applicant submits his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Air Force who served from 30 December 1968 through 28 January 1972. AFPC/DPSID reviewed the applicant’s records and verified his entitlement to the Air Force Outstanding Unit Award with Valor, Republic of Vietnam Gallantry Cross with Palm, Vietnam Service Medal with three Bronze Service Stars and the Vietnam Campaign Medal. His records will be updated accordingly upon final Board action. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial. The Good Conduct Medal is awarded to enlisted members who have honorably completed three continuous years of active military service subsequent to 26 August 1940, and who are recommended by their commanding officers for exemplary behavior, efficiency and fidelity. Persons awarded this medal must have had character and efficiency ratings of excellent or higher throughout the qualifying period, including time spent in attendance at service schools, and there must have been no convictions by court- martial. In accordance with Executive Order 8809, amended by Executive Order 9323, the Good Conduct Medal may also be awarded to service members who complete more than one year, but less than three years of active federal military service if the Good Conduct Medal has not previously been awarded. The applicant’s entitlement to the Good Conduct Medal could not be verified. According to his dates of service, he qualifies for the award of the Air Force Good Conduct Medal under its criteria. He was awarded the Air Force Good Conduct Medal for the period of 30 December 1968 through 29 December 1971. The complete DPSID evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 10 January 2014, for review and comment within 30 days (Exhibit D). As of this date, this office has received no response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the available evidence of record and the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion that relief beyond that already administratively granted is not warranted.
