Her Date of Rank (DOR) to the grade of lieutenant colonel be changed to 14 Jul 12 rather than 12 Nov 12. 2. Her effective date of promotion to the grade of lieutenant colonel be changed to 5 Nov 12 rather than 17 Apr 13. ________________________________________________________________ APPLICANT CONTENDS THAT: Due to an administrative error the State forwarded the position vacancy promotion request on 5 Jul 12, which was never received by the National Guard Bureau (NGB/A1PO). This oversight caused the promotion to be omitted from the Aug 12, Position Vacancy List to the grade of lieutenant colonel. If the promotion recommendation had been received in a timely manner her name would have been submitted to the Aug 12, Position Vacancy List approved by Secretary of Defense on 5 Nov 12. In support of her appeal, the applicant provides copies of a letter from her unit personnel superintendent and her commander; copies of promotion orders, and her promotion recommendation package for a position vacancy promotion. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: On 13 Jul 07, the applicant was appointed as a captain in the Mississippi Air National Guard (MSANG). The applicant was promoted to the grade of major with a Date of Rank (DOR) of 13 Jul 08 and a promotion effective date of 28 Oct 08. The applicant was promoted to the grade of lieutenant colonel with a DOR of 12 Nov 12 and a promotion effective date of 17 Apr 13. ________________________________________________________________ THE AIR FORCE EVALUATION: NGB/A1PO recommends approval. The applicant was originally boarded for promotion on 14 Jul 12; however, her promotion was not submitted to NGB/A1PO in a timely manner due to an administrative error. She was required to be re-boarded for promotion and was eventually processed for promotion on a later list, and promoted effective 17 Apr 13. If NGB/A1PO had received the original promotion request, they would have promoted the applicant with a DOR of 14 Jul 12 and a Promotion Effective Date of 5 Nov 12 (the date that the Aug 12 ANG Position Vacancy list was approved). The complete A1PO evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 6 Sep 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting corrective action. The Air Force office of primary responsibility has adequately addressed the issues presented by the applicant and we are in agreement with their opinion and recommendation. Therefore, we recommend the applicant’s record be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show a Date of Rank (DOR) in the grade of lieutenant colonel (O-5) of 14 July 2012 rather than 12 November 2012 and a Promotion Effective Date (PED) of 5 November 2012 rather than 17 April 2013. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2013-03196 in Executive Session on 15 May 2014, under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the records, as recommended.
