RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03228 XXXXXXXXXXXXXXXXXX COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The Fitness Assessment (FA), dated 24 Jun 13 be declared void and removed from the Air Force Fitness Management System (AFFMS). APPLICANT CONTENDS THAT: He had a medical condition that precluded him from obtaining an overall satisfactory rating on the contested FA. In support of his appeal, the applicant submits a signed AF Form 108, Physical Fitness Education and Intervention Processing, dated 26 Jun 13, indicating that he was evaluated by his medical provider and a medical condition precluded his achievement of a passing fitness score. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: At the time the applicant submitted his application he was serving in the Regular Air Force in the grade of Senior Master Sergeant (E-8). On 24 Jun 13, the applicant participated in a FA, attaining an overall composite score of 25.00, which constituted an “unsatisfactory” assessment. The applicant was credited with the following component scores: Cardio – 35/0.00, Abdominal Circumference – 35.00”/20.00 points, Push-ups – Exempt, Sit-ups – Exempt. A list of the applicant’s last five FA results is as follows: Date Composite Score Cardio Rating 27 Jun 13 100.00 Exempt Excellent *24 Jun 13 25.00 35/0.00 Unsatisfactory 22 Oct 12 Exempt Exempt Exempt 31 May 12 100.00 Exempt Excellent 1 Nov 11 88.00 Exempt Satisfactory *Contested FA On 14 Feb 14, a similar request was considered and denied by the Fitness Assessments Appeals Board (FAAB), stating “The applicant suffered from an injury that was validated by medical, but the AF Form 108 did not indicate what the medical injury was. Also, there was no evidence the commander wanted to invalidate the Fitness Assessment.” IAW AFI 36-2905, Para 9.4.1. “Unit CC or equivalent will use the AF Form 108 as a tool to document mandatory education and intervention requirements. The failure of command or command representatives to sign, annotate, or otherwise complete the AF Form 108 in no way lessens the member’s overarching responsibility for his/her own fitness and compliance with AF fitness standards.” Para 9.4.5. “Medical provider will sign AF Form 108 if member is referred for medical evaluation following an Unsatisfactory score. Members with Unsatisfactory scores may be scheduled for a medical evaluation to determine if there are possible medical indicators that prohibit program success.” The remaining relevant facts pertaining to this application are described in the memoranda prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit B. AIR FORCE EVALUATION: AFPC/DPSIM recommends denial of the applicant’s request to change the contested FA in AFFMS due to the lack of supporting evidence. DPSIM references AFI 36-2905, Fitness Program (dated 1 July 10) AFGM 5 (dated 3 Jan 13) Paragraph 33. "If the medical evaluation validates the illness/injury and provides supporting medical documentation, the Unit Commander may invalidate the FA results by notifying the FAC in writing." No documentation from the Medical Provider or Commander was presented to authorize the 24 Jun 13 test invalidation. A complete copy of the AFPC/DPSIM evaluation, with attachments, is at Exhibit B. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 Feb 14 for review and comment within 30 days (Exhibit C). On 25 Mar 14, in response to DPSIM’s evaluation, the applicant requested that his case be “administratively closed” in order to obtain additional documentation (Exhibit D). On 24 Oct 14, the applicant requested that his case be re-opened and submitted the following additional documentation for the board’s consideration (Exhibit F): a. A signed letter from his medical provider, dated 22 Jul 14, validating he had a medical condition that precluded him from passing the walk portion of his FA on 24 Jun 13. The letter further indicates that on 15 Apr 13 an AF FM 469, Duty Limiting Condition Report, exempted him from the cardio component of the FA. b. A signed letter from his commander, dated 23 Oct 14, requesting that the contested FA be removed from his records. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant is the victim of an error or injustice. The FAAB disapproved the request, indicating that while there was evidence to support he had a medical condition, a commander invalidation letter was not provided; AFPC/DPSIM also concurred based on a lack of supporting evidence. However, the applicant subsequently submitted a signed letter from his medical provider stating that he did in fact have a medical condition that precluded him from passing the cardio component of the test and also submitted a request from his commander to invalidate the contested FA. Given the additional documentation provided, we believe a preponderance of the evidence substantiates that corrective action is warranted. Therefore, we recommend the applicant’s records be corrected as set-forth below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that the Fitness Assessment, dated 24 Jun 13, be declared void and removed from the Air Force Fitness Management System.
