Air Force Good Conduct Medal with two Bronze Oak Leaf Clusters (AFGCM w/2 BOLC). 2. Southwest Asia Service Medal with three Bronze Service Stars (SWASM w/3 BSS) (Administratively Corrected). 3. Kuwait Liberation Medal - Kuwait (KLM-K) (Administratively Corrected). 4. Kuwait Liberation Medal - Saudi Arabia (KLM-SA) (Administratively Corrected). ________________________________________________________________ APPLICANT CONTENDS THAT: He was deployed to the United Arab Emirates (UAE) until 2 Apr 1991. In support of his requests, the applicant provides a copy of his DD Form 214, Certificate of Release or Discharge from Active Duty. ________________________________________________________________ STATEMENT OF FACTS: On 28 Apr 1983, the applicant entered active duty. On 1 Aug 1992, he was released from active duty. He served nine years, three months and four days on active duty. The AFGCM was authorized by the Secretary of the Air Force on 1 Jun 1963. The medal is awarded to enlisted personnel during a three year period of active military service or for a one year period of service during a time of war. Airmen awarded this medal must have had character and efficiency ratings of excellent or higher throughout the qualifying period. In Accordance With (IAW) Executive Order 8809, amended by Executive Order 9323, the AFGCM may also be awarded to service members who complete more than one year but less than three years of active federal military service if the AFGCM has not been previously awarded. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial of the applicant’s request for the AFGCM w/2BOLC. The applicant received an Article 15 which rendered him ineligible for the AFGCM for the period of 28 Apr 1986 to 7 Sep 1988. Due to the Article 15, the entire period was not honorable and is ineligible for the additional BOLC. The applicant’s DD Form 214 is correctly annotated with the AFGCM w/1 BOLC. To grant the applicant relief would be contrary to the eligibility criteria established by AFI 36-2803, Air Force Awards and Decorations Program. Based on a review of the applicant’s personnel records, DPSID determined the applicant should have been awarded the SWASM w/3 BSS, KLM-K and KLM-SA. The applicant’s military personnel records will be administratively corrected to reflect these awards. The complete DPSID evaluation is at Exhibit C. ______________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 29 Oct 2013, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days (Exhibit D). As of this date, this office has not received a response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant award of the AFGCM w/2 BOLC. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
