RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03345 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He receive payment of his authorized enlistment bonus in the amount of $10,000. APPLICANT CONTENDS THAT: He signed an enlistment agreement authorizing a bonus payment and although he fulfilled the terms of the obligations for which the bonus would be paid, he never received payment. He made multiple unsuccessful attempts to correct this error since 2001. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 16 Nov 00, an AF Form 3008, Supplement To Enlistment Agreement – United States Air Force, was initiated by the applicant, electing an initial enlistment bonus option. Specifically, upon completion of technical training and award of the three skill level in the Air Force specialty 2F031, he would be authorized payment of an initial enlistment bonus in the amount of $10,000 payable not earlier than one month after arrival at his first permanent duty station. On 3 Jan 01, the applicant’s military personnel records indicate he enlisted in the Regular Air Force. According to the applicant’s AF Form 910, Enlisted Performance Report (AB thru TSGT), rendered during the period 3 Jan 01 thru 2 Sep 2002, his duty air force specialty code (DAFSC) is annotated as 2F031. On 2 Jan 07, the applicant was released from active duty and transferred to the Air Force Reserve for completion of his military service obligation. He received an honorable discharge and was credited with 6 years of active duty service. On 11 Sep 14, pursuant to the Boards request, the Defense Finance and Accounting Service (DFAS) confirmed that records reflect the applicant did not receive any bonus payments. The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility (OPR) which is included at Exhibits C. AIR FORCE EVALUATION: AFPC/DPSIPE recommends approval. After a thorough review of the applicant’s military personnel record and the supporting documentation provided by the applicant there is an error and an injustice, if he was not paid the entitled bonus. The DD Form 3008 reflects that the applicant was authorized an initial enlistment bonus in the amount of $10,000. If DFAS validates that he did not obtain the $10,000 bonus, approval is recommended. A complete copy of the AFPC/DPSIPE evaluation, with attachment, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 8 Sep 14 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief should be granted. In this respect, we note that the Defense Finance and Accounting Service (DFAS) has verified that there is no record of the applicant receiving payment of his guaranteed initial enlistment bonus. Therefore, since the applicant was entitled to a bonus payment, we recommend the applicant’s record be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that on 22 May 2001, having successfully completed the training and terms of obligated service required for payment of the enlistment bonus promised in his 16 November 2000 Guaranteed Training Enlistment Agreement, he submitted a timely and valid demand for payment of the full amount ($10,000).
