Her gap in service between her Date of Separation (DOS) and her entry into the Air Force Reserves (AFR) be eliminated. APPLICANT CONTENDS THAT: Her DD Form 214 is inaccurate and missing key information from her Air Force career. She called the Air Force Personnel Center (AFPC) help desk regarding her concerns and was informed her DD Form 214 would be verified against her records and not to worry about it. Her gap in service is through no fault of her own and will have significant implications to her career. She was assured by her Reserve Recruiter there would be no break in service. In support of her requests, the applicant provides copies of her DD Form 214; AF Form 1056, Air Force Reserve Officer Training Corps (AFROTC) Contract; AF Forms 707, Officer Performance Reports; ARPC IMT 92, Appointment Order and various other documents associated with her appeal. The applicant's complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 19 Sep 05, the applicant was commissioned in the Regular Air Force. On 27 Feb 14, AFPC/DPSIT notified the applicant that based on a review of her personnel records, they were able to verify she completed the Air Force Nuclear Management Fundamentals on 16 Mar 12, and BMDS Fundamentals on 22 Apr 11. DPSOY will administratively correct the applicant’s records to reflect these courses. According to an SAF/MRBR Action Request, dated 31 Jul 14, the applicant’s DD Form 214, Block 15b, Commissioned through ROTC Scholarship, will be administratively corrected to reflect “Yes.” AIR FORCE EVALUATION: DPSIT recommends denial of the applicant’s request to add the Space and Missile Intelligence Formal Training course to her DD Form 214. The applicant did not provide any supporting documentation to verify she completed the course. The applicant may submit additional documentation for reconsideration. The complete DPSIT evaluation is at Exhibit C. AFPC/DPSIC makes no recommendation regarding the applicant’s request to change her DD Form 214, block 11, Primary Specialty. The Office of Primary Responsibility (OPR) for the DD Form 214, using the regulatory guidance for the DD Form 214 content at the time of the applicant’s separation, should determine which Air Force Specialty Code (AFSC), title (AFSC title or individual duty title) and periods of service are correct for inclusion in block 11 of the DD Form 214 The applicant’s DD Form 214, block 11, Primary Specialty, issued in conjunction with her 26 Jul 13, separation reflects AFSCs X13S3C (Nonrated Aircrew, Space and Missile Ops); 13S3C and 13S2C (Missile Combat Crew and Space and Missile Ops, Missile Combat Crew) respectively. As of 30 Apr 13, these AFSCs were no longer valid because they were converted to Air Force Specialty 13N (with the respective prefixes and qualification levels) effective 1 May 13. Therefore, the applicant’s awarded AFSCs, provided she remained qualified to hold them at the time of separation would have been 13N3 (Nuclear and Missile Operations); K13N3 (Instructor, Nuclear and Missile Operations); and X13N3 (Nonrated Aircrew, Nuclear and Missile Operations). A Military Personnel Data System (MilPDS) report dated 14 May 13, reflects a primary AFSC of 13N3 and secondary AFSC of K13N3. No other awarded AFSC were identified. The complete DPSIC evaluation is at Exhibit D. AFPC/DPSID states the applicant’s record has been corrected to reflect the MSM w/1BOLC. The complete DPSID evaluation, with attachment, is at Exhibit E. AFPC/DPSIC recommends denial of the applicant’s request to change her DD Form 214, block 11, Primary Specialty as requested. These AFSCs are no longer valid as of 30 Apr 13 and should not have been incorporated in the DD Form 214 resulting from her 26 Jul 13 separation. These AFSCs (to include personnel and manpower authorizations) were converted to Air Force Specialty 13NX effective 1 May 13. As such, the old AFSCs were ineligible for incorporation in the DD Form 214 issued in conjunction with her 26 Jul 13 separation. AFI 36-3203, Separation Documents, table 4, “How to Prepare the DD From 214,” Rule 14, Item 11, Primary Specialty states “enter the primary AFSC (PAFSC) and all additional AFSCs in which the member served for 1 year or more, during member’s continuous active military service. In each AFSC, show the highest skill level in which the member performed duties. For each AFSC give the AFSC title (not duty title) with the years and months of service.” In addition, the DD Form 214 Personnel Services Delivery Guide further refines the use of multiple variations of the same AFSC with “if the airman performed duty in the same AFSC with multiple shred outs (i.e. X11S4X and Y11S4Y) only the base specialty is included on the DD Form 214 (in this example, 11S4).” Her DD Form 214, block 11 should only reflect AFSC 13N3, Nuclear and Missile Operations, 7 years and 10 months. The complete DPSIC evaluation is at Exhibit F. ARPC/DPA recommends approval of the applicant’s request to remove her break in service. Current policies do not allow for backdating oaths; however, SAF/GCM and the AFBCMR have determined the Board has the authority to adjust the DOS for these officers to prevent a break in service. OSD General Counsel (GC) determined the appointment date is the date the OSD approved the appointment or the date the oath was administered, whichever is later. On 11 Mar 13, the applicant’s name was scrolled and on 26 Jul 13, she was discharged from the Air Force in the grade of captain. In addition, on 31 Jul 13, her appointment was approved by OSD and she accepted a commission in the Reserve of the Air Force Reserves. ARPC found no administrative error and concludes the break in service was at no fault of the applicant. The applicant’s appointment order, PC-00017, dated 9 October 2013, was issued IAW AFI 36-2005, Appointment in Commissioned Grades and Designation and Assignment in Professional Categories – Reserve of the Air Force and United States Air Force. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 1 Aug 14, for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit H). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant changing the applicant’s DD Form 214, Block 14, to add the Space and Missile Intelligence Formal Training course or to change block 11 as requested. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of DPSIT and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. 4. Notwithstanding the above, sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant removing the applicant’s break in service and to correct her DD Form 214, block 11, to reflect AFSC 13N3, Nuclear and Missile Operations for 7 years and 10 months. Having carefully reviewed this application, we agree with the recommendation of the DPA and DPSIC and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. We also concur with the administrative corrections noted above. Accordingly, we recommend the applicant’s records be corrected to the extent indicated below. 5. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that a. Her DD Form 214, Certificate of Release or Discharge from Active Duty, issued in conjunction with her 26 July 2013, separation be amended in Block 11, Primary Specialty, to reflect 13N3, Nuclear and Missile Operations, 7 years and 10 months. b. She was not discharged from the Air Force on 26 July 2013, but was continued on active duty until 30 July 2013, on which date she was discharged from active duty.
