RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-04055 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His Home of Record (HOR) be changed from “Jena, Louisiana” to “New Hope, Alabama.” ________________________________________________________________ APPLICANT CONTENDS THAT: He lived in Alabama at the time he enlisted. He was a visitor of Louisiana and not a resident when he enlisted. He graduated from high school in May 68 and enlisted in the Air Force in Oct 68. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: On 23 Oct 68, the applicant commenced his enlistment in the Regular Air Force. The DD Form 4, Enlistment/Reenlistment Document, reflects his HOR as Jena, Louisiana. On 27 Jul 71, the applicant was honorably discharged. He reenlisted in the Regular Air Force on 28 Jul 71 and the DD Form 4 executed with his re-enlistment reflected his HOR as Jena, Louisiana. He was released from active duty on 5 Jul 72. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force, which is attached at Exhibit C. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIPE recommends denial indicating there is no evidence of an error or an injustice. After reviewing the documentation presented and the applicant’s military personnel record, there is no evidence to warrant changing the applicant’s HOR. The DD Form 4 is the source document for HOR and place of entry (POE). The Joint Federal travel Regulation (JFTR) defines the HOR as the place recorded as the home of the individual when reinstated, reappointed, or reenlisted remains the same as that recorded when commissioned, appointed, enlisted, inducted, or ordered into a tour of active duty. The HOR can only be changed if there is a break in service of at least one full day. The HOR is listed by the individual upon entering military service, not a location where the individual is later assigned or a location selected for convenience. A correction to the HOR must be fully justified. The domicile or legal residency may change, but the HOR will not. The AFPC Officer Accessions Branch confirmed the applicant initialed the DD Form 4 dated 28 Jul 17 which lists Jena, Louisiana has his HOR. A complete copy of the AFPC/DPSIPE evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 7 Jan 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice.
