RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-04296 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: The decedent’s DD Form 214, Armed Forces of the United States Report of Transfer or Discharge; be amended to reflect he was honorably discharged. _______________________________________________________________ APPLICANT CONTENDS THAT: Upon her husband’s death, it was discovered that he is listed as only serving in the Reserves. He served on active duty from 19 Jun 56 to 18 Jun 60; then in the Reserves from 18 Jun 60 to 18 Jun 62 for a total of 6 years. In support of her request, the applicant provides a letter from the National Personnel Records Center (NPRC), copies of the decedent’s DD Form 214, DD Form 256AF, Honorable Discharge Certificate; Reserve Orders dated 31 May 62, and death certificate. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: On 19 Jun 56, the decedent entered active duty. On 18 Jun 60, he was released from active duty. He served 4 years on active duty. Upon his release from active duty, he was transferred to the Individual Reserve Section to complete the remainder of his Military Service Obligation (MSO). On 18 Jun 62, he was discharged from the Air Force Reserve. ________________________________________________________________ AIR FORCE EVALUATION: ARPC/DPTS recommends denial. The decedent’s DD Form 256AF and discharge order are correct. He was not on active duty when he was discharged. His DD Form 214 shows he was released from active duty and incurred his Reserve obligation until 18 Jun 62. The decedent’s family can be assured that his 6 years of total military service is recognized, just not all of it on active duty. The complete DPTS evaluation is at Exhibit B. ____________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 24 Jan 14, a copy of the Air Force evaluation was provided to the applicant for review and comment within 30 days (Exhibit C). As of this date, this office has not received a response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our conclusion. As reflected on his DD Form 214, he completed four years of active duty service and was released on 18 Jun 60 to complete the remainder of his MSO in the Reserves. On 18 Jun 62, he was honorably discharged from the Air Force Reserve as annotated on his DD Form 256AF. The decedent’s complete service is recognized and correctly documented.
